Wells Fargo demanding I resubmit my already approved medical accommodation

I have a medical accommodation to telecommute that was approved as "ongoing" a couple years ago and now they are demanding that I go through the review process again. I suspect they are already planning to deny a new submission. Do I have any ability, under the ADA, to push back?

Do it on company time. What’s the problem with them continuing to ask? It just means we are inefficient. Thought most people knew that already.

I have seen this play out with others. The crux of your dilemma will be what constitutes a reasonable accommodation. Your preference is to work from home, but WF will exhaust all other ways to meet your needs before approving you to stay home. So, your accommodation request may ultimate get approved, but the actual accommodation that is offered to you may not be what you are hoping for. Hope your doctor is able to document why WFH is the best accommodation for your personal situation. Good luck.

Meh, I hid my disabilities from them, because I didn't trust them.

I still got whacked, but it wasn't because of that.

It’s an annual attestation now. Look at all the other threads on this. Nothing to do with you personally just procedure. If you’ve got a valid reason you will approved. If your doctor signed off on something that was iffy in the first place (there’s a lot of abuse on this) then yes expect further review (as should be). I’m sure you’re fine.

Doctor letter or not, will not be approved. They may make some accommodation to sit near bathroom, near window or even have your own office.. if it was approved last year or ongoing—they won’t approve it. Escalate all you want and still no

They did the same to me last year, beginning of 2023 and then again this year. Be prepared to be Charlie'd at some point in the future. You will be cut because of "downsizing" or whatever b.s. excuse they can find that they can get away with legally.
I was let go last Tuesday along with 46 other people, 93% of them were over 40.
You can try the ADA and attorney route, but you can bet WF has already covered their butts. Save your time and energy and start mentally and financially preparing for the inevitable and pray they don't get rid of severance in 2025. The 60 day working period will remain, as that is their CYA for the Older Workers stuff. Remember, WF has stated many times they are offshoring 40% of their US workforce. Good luck to you

Serious question, so please. I am a high functioning person that suffers from depression. Should I seek some accommodation for the additional stress? Or would that just be the last nail in my coffin career wise. I am very good at my job, but suffer with some bad days of depression that impacts those around me. And yes, I see a medical professional for it.

The sum of it is that every accommodation is now subject to periodic review (annual or semiannual). The fact that you came up for review doesn’t mean anything other than that.

ADA only applies if you have a condition that qualifies as a disability under that act. So that’s the first question.

Assuming you do, then ADA requires “reasonable” accommodation to be provided, unless it causes “undue hardship” to the business.

Accommodation isn’t required to be WFH - if there are other accommodations that address your disability then they will offer those.

The answer to this is easily searchable on the Internet and has been asked and answered on this site many times. It seems to me you are just lazy and WF doesn’t have to give you an accommodation for laziness.

Annual reviews are standard now. It's horse S, but it is what it is. They are free to do it. I think the only legal risk is when a lawyer can show that they don't REALLY consider the request before denying it. Company lost a suit on that basis just this year.
