Reminder: Legally They Dont Have To Give Severance During Layoffs

People continue to say RTO is a way to get rid of people without having to pay severance.

Here is the reality: legally they are not required to giver severance during a layoff. They could just get rid of you and give you NOTHING. They could change their severance policy tomorrow and put in no severance as the only option. Or they could give it just for certain levels. Everything goes.

Companies give severance hoping to smooth things out with you so you dont go after them for laying you off.

Also remember that severance is taxed like a bonus and the govmt takes 40% off the top.

Severance is a payoff to prevent wrongful termination lawsuits. You have to promise not to sue to get your package. Without severance it will be civil court Armageddon for AT&T.

Please look up the difference between withholding and taxation.
Taxes are withheld from bonuses at the supplemental rate of 22%.
Whether or not you get anything back when you file depends on your income and what your marginal tax rate ends up being.

Who is your tax attorney/CPA. No. Severance and bonus are taxed like regular income. But, if you make $100K this year and then take a $50K severance next week, you’ll be taxed like you made $150K because you did. There might be some issue with withholding but if you’re overtaxed on your check, you’ll get it back when you file

just going through surplus you have an option to defer your severance. If you receive a paycheck from AT&T in the same calendar year as your severance then it is treated as a bonus. If you defer it to next year which will be paid prior to march it is taxed as a paycheck.

I love how you’re stating this as if you’re smarter than everyone else. Everybody knows severance is not a legal requirement.

That said, it is pretty much standard practice for any corporation.

Would be highly unlikely and an extremely bad look for T reduce its already below standard offering, much less cancel it all together.

In other words, they can completely be a real je-k and continue to be so with other incompetent useless hypocrites egotistical liars top executives that keep saying (“we’re not gonna do stupid”) especially when they see a post like this which would only encourage them to lay you off without the severance. They will laugh har har har and walk away. Ok, I’ll let the Highest Power to take care of them.

Dallas is just a temporary stopover for your position because ultimately it’s going offshore or contracted and more than likely to India. Been happening for a while, some employees have finally woken up to the deception and the master plan of offshoring or contacting out as many positions as possible.

Please start with downsizing staff support that continue to come up with policies, programs, systems and ways to micromanage to remain relevant. It’s like the government, they keep layering on regulations and needless tasks that are counterproductive in order to justify their own positions.

I think you have to sign something saying you won’t sue them ever in order to get the severance.

They do but there are several lawsuits going on related to the validity of the severance waiver.

Employers generally use two different ways to pay your severance:

As part of your normal wages. That means all the normal withholding (such as federal income tax based on your completed W-4, state income tax, Social Security and Medicare taxes) that applied to your paycheck, will also apply to your severance payment.
Apart from your normal wages. In this case, a flat 22% withholding rate for federal income tax (in place of the normal federal income tax withholding that would be calculated based on your W-4) would generally apply.
