Employment Attorney Help

Do you think that I might have shot if I was to pursue my case legally, I was very close to retirement, had stellar reviews and people with less experience and less knowledge were left while I was let go. I cannot share more details but wanted to see what you all think about this? I think that I may have a shot, at the same time I have very limited financial means to withstand a protracted legal battle.I hope we'd get a Class Action suite here (I think there was an issue with WARN notices too - so that might be a class action as well). Thoughts are appreciated.

Glenn Endress would not accept EOIs ? so there might be class due to differential treatment among LTs. However can be long protracted so for individuals to weigh along with counsel. ELT in general has not handled this downturn well at all - overhired overspent no cash on hand cronyism -- same old thing that can wreck a good company - sad thing is lots of brilliant talent experienced hires very mistreated . Maybe ELT and Board will learn a hard lesson when they fail and lose the company in total. Some people do not learn from history's mistakes.

Jack Williams laid off employees that are over fifty from his group but kept all the younger people. Would those people have a case

Google EEOC & age discrimination and follow the process to file a complaint. The Labor Department is very familiar with ConocoPhilips and ConocoPhillips is very familiar with the Labor Department. No lawyer required to file a claim.

Only a lawyer can tell you if you have a case (or they are willing to take it on). More often than not, you will be able to find an attorney willing to take just about any case on. However, you don't necessarily need to hire a private attorney if you believe you are being discriminated because of your age. Age discrimination is protected under Federal Law. Talk to the Equal Employment Opportunity Commission (EEOC). They have field offices all over the country. Schedule an appointment and in the meantime, document everything that's happened with 100% accuracy.

Best of luck!

Isn't age discrimination illegal regardless of whether or not a "do not sue" agreement was signed?

What is the loss? What is the gain if you continued to work at ConocoPhillips until retirement? How long did you work at ConocoPhillips? Severance? Layoff? Fired? A layoff in the current environment is more often than not a positive. The current round of layoffs are only the current round of layoffs and future layoffs may or may not be as generous. The departure of the HR VP is proof positive the layoffs are not above board so a case for a lawsuit does exist. The do not sue letter is associated with the severance for a number of reasons.
