I tried negotiating my severance and I was told by Jason Bergin, Ned Fite, and Alexis Hunter that there was no negotiating.

I did during the 2008 crash though. From 2 weeks, I requested 16 and got a counter offer of 12. Which I accepted.

Only need a lawyer for advice. The purpose of negotiating is to avoid the courts. Your jurisdiction might have a free half an hour lawyer hotline. I am so glad you are talking about renegotiating, rather than suing. I wish others knew this. a severance is to accommodate one until new work is found that pay similar amount. Since this is a Massive downturn, a long severance should be likely. I rewrote the offered severance word by word, and then listed reasons why it needs to be so high. if you can throw in Stats like the local unemployment spike, making it difficult. That the competition has hiring freezes, Yada yada yada.

Don't forget to put a deadline on your counter offer.

Like the first reply said, get yourself a lawyer. Plan ahead, when the call comes have your lawyer's prior plan ready and present it. But how much is this gonna cost in lawyer fees, time and trouble. Although you may have a lot of time available now. Is the actual severance that bad to begin with? Come on.

I know of one guy that did it and got 32 weeks pay but I don't know how he did it.

Do I simply decline the offer until it meets my standards or will they basically terminate my employment without severance? How firm should you be?
