Thread regarding Qualcomm Inc. layoffs

QCT fellows if you don't agree with layoff terms or if you work 50+ without overtime pay

Guys lets form a group to see what choices do we have and what else we can do. I would like to get all people that received the layoff package and work on something.

@ 125100: You do have access to the evidence. Request your complete employee file and copies of all contracts or other documents bearing your signature that are related to your employment with your employer. Send a certified letter to c/o your assigned HR person if you have one, or Qualcomm Human Resources, 5775 Morehouse Dr., San Diego, CA 92121-1714. Both state and federal law require that your employer provided them upon request. Once you retain an attorney and file a lawsuit, you have to get them through discovery. That will probably cost you at least a couple thousand bucks....

@ Anonymous125030 do you think that HR does not know about how do they exploited QCT employees? HR does not care and we cannot bring this to DOL as we need evidence, that is the reason why we need to be all together and find a way to be listen by the DOL u other...

If you think you have a wage and hour issue, e.g. overtime, contact the DOL. If you feel you have been discriminated against by your employer, contact the EEOC. The email contact numbers for your local office are online. (Make sure you use the government websites that are updated more frequently than most attorney websites.) If you are serious about filing a lawsuit, contact your local bar association for a list of attorneys who are familiar with practice in these areas. For god's sake, DON'T hire one of the guys from TV who promise to take your suit with no money down, and no payment unless they get you a recovery. Unless of course you don't mind being bought off for just enough to cover the costs and attorneys fees. ...And if the HR people really are posting on this board, remember that you are employed by a company that has it's own corporate counsel. Perhaps its time for them to schedule one of those boring review sessions on the perils of using third party internet sites to spy on employees for the company.

Guys I posted this just to make a group and find solutions, I was (still until now) being exploted by QCT, we all have records independently of the QTime, so please whoever is interested let's meet all and let's talk. Thanks I am a QCT employee by the way...

It would be super hard to prove that you were forced to work for 40+ hours. Every week you have singed a timesheet on which you could never have put more than 40 hours. Besides I doubt any lead would have asked you to work overtime in an email. It is all matter of setting expectations. If you gave in to perceived pressures to work beyond normal hours, it is your problem.

I think one of the easiest thing to do is to talk to DOL and see what they can do.DOL is enforcing US labour laws and can investigate and make companies to pay for unpaid work.
