Thread regarding Qualcomm Inc. layoffs

Just got fired. No severence.

I was escorted out by security. There was no specific reason given. The security guy said it had something to do with my conduct online. I once accidently posted something on this website using while on Qualnet that some may consider racist. Could that be the reason? I have been performing well, 5 on last review. Is there anything I can do?

We should all request copies of employee files from HR. A friend of mine asked for his and HR stalled. When he finally got it, there was a copy of a contract in it that he had never seen before, which changed the terms of his work. It was electronically signed, so it's hard to tell who actually signed it. One problem: It was electronically signed BEFORE he actually started working at QC and had access to QCOM machines. You have a right to the information. Plus you never know what you'll find that might be useful in negotiating your GTFO package.

OP: You're welcome. Personally, I wouldn't attempt getting rehired. Life's too short to work for people who are willing to throw you under the bus when the going gets rough. And don't look to make a killing in a lawsuit. That only happens in movies and on those crappy late night commercials for other lawyers. Let your attorney try to max out your settlement. There are other positions out there. It may be rough for a few months, but get a plan, and start looking. With QCOM in it's current state, a lot of people are leaving before they get pushed out, so I doubt that too many questions will be asked by potential employers.

Freedom of speech does not exist in private corporations. The law only applies to public speech. Is posting on a website on company time and equipment private or public speech? If I do it from my own computer, on my own time, I'm free to express my opinion in any way I choose. And I choose to claim that the OP is just a juvenile joker :-)

And we (from HR) don't fire anybody because of a post on a website. If you really got "fired", you would be totally eligible to ask for the reason from us. While employment is as "will", it doesn't mean we just simply fire employees for expressing their views. This would be against freedom of speech and constitution law.

I work in security. We are never given a reason. We are just told to go to a building and cube and escort the person out. Often we told to report to a conference room where the bad news has been delivered to the individual and then I escort them to get their belongings. Again, we never know any details.

Actually Labor Lawyer, if OP did it on a QCOM machine, on their time, and using their internet, the employer DOES have the right to exercise control over what the employees say. And in case you forgot to brush up on CA's "at will" statute, an employer does not need a reason to terminate your employment. On the plus side, OP, take some comfort in the fact that a lot of people are getting terminated under similar circumstances at QCOM for reviews that falsely downgraded their performance. Whoever told you it was because of an internet post was most likely just being a jerk. But the fact that you were just suddenly escorted out may also mean that HR is not even bothering with PIPs in some cases--which may actually work in your favor if you do have a history of good reviews, and if you have no prior history of discipline in your employee file. Send a request to HR by certified mail for a complete copy of your employee file, and any documents that you were required to sign while at QCOM. Make sure you spring for the green postcard that verifies the date of receipt. (HR has to send it to you within 30 days of receipt--or you DO have a valid claim against them.) Once you receive the file, check to see if you have any notations of disciplinary actions in your file. If you don't, and you feel you have been discriminated against, file an EEOC complaint as soon as possible (--forms available online--) and request that they file one with state agencies. Make an appointment with them and discuss your options. THEN hire an attorney who actually knows what she is doing.

HI. OP here. I forgot to mention. One time I put my foot on the accelerator in my car while in park. The engine raced above 5000 rpm even though it was an accident and the car didn't even move. Nonetheless, the police showed up the next day and gave me a ticket for reckless driving. Do you think it was because of this website, as well?

0P is HR. This is a bullshit post. There is no way that they know what you're posting online. I work in the IT department. We're a bunch of f***ing idiots. The majority of the websites visited at QUALCOMM are porn followed by YouTube. I saw this during an all hands meeting when I first started. There is no way these retards in HR with degrees from the University of Phoenix could possibly track a particular post to a particular post unless they had some monitoring software installed on your computer to begin with. Even at that, I would see a lawyer. Being racist is not illegal. I work in the IT department. We are too stupid to even back your computer up computer and email up correctly, let alone watch what you do online. HR, go get an online degree in IT security.
