My manager called me up a few times after I got RIFed just to scream and shout at me. Do I have a case for a suit if I already signed the agreement?

180608: Not all of us grew up in cultures that treat women like shit, and that expect us to be subservient. One guy I worked with kept making sexual comments to me--about his "big ten inch." The first time I pretended I didn't hear him. The second time, I decided this was going to stop. "I pulled a $20 out of my purse, slapped it on my desk and said: "$20 says you're full of shit!" Then I pulled out a ruler and said loud enough for the rest of the women in the "cube farm" to hear: "'John' says his dick is $20 long. I think he's full of it. Who else wants in on this?" "John" went back to his desk and was well-behaved after than. Another time a boss decided he'd get abusive. I sent him an email telling him that I refused to tolerate further abuse from him and that his phone privileges were revoked until further notice. But law suits are a time-sink, and usually the only people who make money are the lawyers.

Here is the text of the law protecting older workers during a layoff, but it is pretty complicated to read so you need a lawyer for legal advice. @ I tried: That's not entirely true. QC can't condition your 60 days salary and benefits under the WARN Act on not suing. They are obligated to pay you that by law. And if you worked, they had a preexisting duty to pay you. If you are over 40, they can't make you waive your rights under the OWPBA. If you signed for a severance package but haven't received the severance package yet, you may be able to pursue a suit. Best thing to do is see an attorney who specializes in employment law.

Possibly. Get a small notebook and keep it with you at work, but don't leave it at work, and don't let anyone else see it. Write down all of the incidents you can remember. Stick to facts: date, time, what was said, who said it, names of witnesses. Also write down the names, approximate age, gender, and race/ethnicity of other people who were treated the same way, and approximate age, gender, and race/ethnicity of people who received favorable treatment, if applicable. If you reported it, make a note of the dates, the people you talked to, and the action taken--if any. IF this person sent snotty emails, keep copies. Make an appointment for an interview with the local EEOC as soon as possible after Nov. 20 GTFO date.
