181220- exactly what I thought. They can't force us to withhold confidentiality. Some of the clauses seem to be in violation but they are covering their asses.

That contract is a disgrace. It's poorly drafted. It has typographical mistakes in it. It even has clauses that violate NLRA. For example the retro-active (and prospective) non-disparagement clause in the contract has been found by the NLRB to violate NLRA 7 and 8. The finding is being appealed in the 9th circuit - which will almost certainly uphold. The arbitration clause is insanely unclear. The confidentiality clause is also legally suspect. It's truly a mess of a contract and I hope ex-employees sue them on it and go to the NLRB about it.
