WF UNEMPLOYMENT BENEFITS IN TEXAS

Good Day to all!

I recently applied for my unemployment benefits in Texas. I was given my amount of what my benefits would be, etc. Upon the first time to report my bi-weekly claim status I did everything that TWC directed me to do in job searches, true and factual information, recording pay in lieu of layoff, etc.

Now I am told that TWC has my benefits on hold as they further check with WF to determine if I am eligible. I am like say What???????????????????????

So....geez no unemployment benefits now until further review of my claim is under going the process...smh

They may have been told not t contest, but my store IS fighting my unemployment claim. Store is claiming I chose to leave by not taking the option where I apply for a different position in the store. I was a graphic artist so the other positions were joy my usual line of work. They are trying to say because I didn't take that option I should not be eligible for any unemployment! I have kids to feed, making me so mad!

in the state of texas you can't receive unemployment and severance. They will hold your unemployment until the weeks that you got paid as severance "run out" For example 8 weeks plus whatever weeks you received as severance.

Also, remember you will need to pay taxes for unemployment as it is consider an income. You can file a form to have the IRS hold 10% of it or you need to do it on your own.

It has more to do with texas law and how the pay is recorded. Severence is supplemental pay. It is income. T.W.C calculates your unemploymeny pool. In order to obtain it, you have to continually meet specific weekly requirements. You will not get a check for unemploymwnt until the number of weeks you took severence for expires..and that ENTIRE TIME you have to meet the weekly t.w.c. requirements (submitting apps, etc). I mean seriously..you thought youd get another check on top of this? Its not as if you were laidoff with no severence (if they gove notice, its not required) and had NO money.

Wfm is not contesting unemployment because in most cases, people will have found work before their severence timeframe runs out, and thus no benefits need be paid.

It has nothing to do with wfm. It is state labor laws and federal tax laws.

my tms told me that they were instructed not to contest the filings, but according to texas they will not pay until the 8 weeks wages in lieu of notice runs out

That happened to more last year, twice. Get a free lawyer and scare them off.

If they layoff as many tms as they do, what do they expect?
