Getting a job during your 2month pay

Are you prohibited from getting a job during your 2 months of additional pay. If you obtain a job during your 2 months of pay will you still get your severance.

I got a job offer three weeks before my last day in the office, they wouldn't wait longer than two weeks for me to start. I labored the decision but decided to forego the severance and six weeks and worked one more week (I needed a week off in between). Not all employers are going to wait a month if they need someone. Fortunately, I had only been at chevron five years so the severance was just ten weeks. But still ....I was kind of looking forward to having six weeks paid off since I only got two weeks of vacation at chevron a year.

anon989...I am not a lawyer nor am I misinformed. I said "SEVERANCE"!! It doesn't matter what you do once your severance is paid. I was not addressing the notice period as anyone who reads and signs their notice would know their last day of effective employment.

Unused vacation days are paid after the final date of employment, along with severance pay.

If you've been laid off already, the details are explained in the letter you should have received when you were laid off. But, for those asking that might still be working, here is a simple summary for you.

There are usually two dates provided by Chevron. Your final day in office, and your final day of employment. There is typically a 6-week duration between when you leave the office, where you still get paid and full medical benefits. Yes, sit at home for 6 weeks and get paid, not a bad deal. You can job hunt and interview in that time. Then you arrive at your final day of employment. After that final date, CVX sends you a release form to sign and send back to them. Then you are awarded your 2-month severance pay. You can do whatever you want, after that final employment date.

You cannot start at a new job until that final date passes. If you do, and CVX finds out, they will assume you "quit" CVX, and they will not be obligated to pay the severance package. My final date is Dec 8th, therefore I cannot start a job on someone else's payroll until Dec 9th.

Simple.

I received my severance check (all 1-year salary worth) minus 25% Federal tax withholding. They also deducted my contribution percentage towards my ESIP 401k plan. I was laid off in April, so after my 60-day sabbatical at home, they paid my severance about 2 payroll periods later. Damn jerks at Chevron were so cheap, they mailed to me via first class mail (not FedEx).

Agree with others here on waiting the 60 days. Any new prospective employer will contact the HR debts of your previous employers on your resume to confirm that you worked there. If that happens within your 60 days it would be a big tipoff to Chevron, and you would likely lose the remaining 60 day salary.

Severance is compensation for past work not future employ - you think those receiving the maximum 1 yr US or 2 yr UK are going to do nothing for the next year or two?

Of course not. Do what you need to do and best of luck - I'm sure every company laying off staff will be happy for everyone to get a job just as soon as they can.

917, are you a lawyer? I doubt not. The severance payout is part of an agreement. Break the contract and you could lose it. Seems like you are misinformed or just want to create mayhem. If it's the latter, may it come back to you ten-fold.

This was asked already. Don't tell chevron. Wait until after the 60 days are up to officially start your new role. Use the 60 days full pay by chevron to relax and unwind and don't lose your dignity by whining a lot to your new employer about chevron.

Agree with 1852. I received interviews and job offers during my two months pay out of the office and lined up my new position to start 2 weeks after my last day on payroll. This avoided any excuse Chevron may use to cancel my severance package.

It possible Chevron won't find out immediately about your new job. But, if they do for some reason, you will have effectively "quit" your job while on Chevron payroll. The result would be no severance check. The best course would be to accept the offer of the new job, just tell your new employer you cannot start until after your 60 days are up.

Why would you even care? What are they going to do, fire you again? Just don't tell them and don't share the info on your f***ing Facebook.

Maybe get a job in Australia, one of those cushy FIFO deals where they'll fly you home if fluffy gets run over? Pet bereavement, only way to work in the oilfield.
