I remember getting a letter in mail from Baker about a lawsuit similar to this a while back. They had employees that were working long hours in the field (way past the standard 12 hour shifts) and were being paid a set day rate. I think this was found to be a legal issue in certain states like New Mexico, Oklahoma, and Pennsylvania (If I remember correctly). After I left the field, they did end up switching to hourly pay and I assume it was due to some legal issue related to that case.
