I work for Kmart offshore region. We are going to be told today about the new company And how we will move forward. I don’t have a doubt in my mind that this is not going to be pretty. I am almost sure that they will start getting rid of what is left of us full timers before the transition is complete. I will post later on as details come available.

You're not being "forgotten about". The whole company is dying, and there's not enough money to go around. If Sears ends up not being able to pay what they owe to hundreds of vendor businesses large and small, the amount of Sears debt they have to take a loss on may put some of those vendor businesses out of business too. You not getting the rest of your severance is helping more of those companies' employees not lose their jobs too. You were paid in full for the time you worked. Many people don't get a severance at all.

After SHC filed for bankruptcy proceedings you are now a creditor to SEARS / Kmart - you want dinero you need to file a claim and stand in line with everyone else p.s. you will be last on the totem pole

Our store closed 9/14/2018. Full timers that were left were offered 8 weeks Severance +vacation pay that was left over.Took us a few to get since we were unaware of the fact that all the correct paperwork was not turned in. So everyone was alerted and got it turned in. We received 2 severance payments+vaction. We unfortunately do not get our last 2 payments due to the fact that sears filed bankruptcy. This is totally unfair for all of us. Our years of employment ranged from being there 14 years to 40 + .where is the justice for all of our blood,sweat and tears we poured into the company. Only to be forgotten about in the end.why do we not have the right to get what we have coming to us. If anyone knows anything else we could do please let me know. Just not fair..

Part timers get nothing, no matter how long you have worked for SHC. I worked for Sears part time for over 15 years and when my store closed I got nothing.

Severance is for full timers only, part timers get nothing. If you are a full time employee you will get one week for every year you have been full time up to 8 weeks.

For example: if you started out as a part timer 10 years ago and worked part time for 6 years and then for the last 4 years you have been full time you will get 4 weeks pay. Or another example: If you have worked full time for the last 15 years you will only get 8 weeks of severance.

Another example: IF you worked full time for another store and the store closed or you took some sort of severance then you will not be eligable for severance in your new store no matter how long you have been at the new store.

I believe that management gets up to 26 weeks severance for every year of service. Continuing Benefits like health insurance will be what ever they decide when you sign your papers. Read them very carefully and get a lawyer to go over them.

If the company files BK then all severance, vacation, sick leave is off the table.

Why do we have to sign a waver to receive our severance pay and why is it capped at 8 weeks when your employment is more than 20 years and why is it that the labor dept is not interfering.

One week for every year of service. That amount is capped at a maximum of 8 weeks no matter how long you have worked for SHC. Management (salaried) get a max of 26 weeks. part timers get no severance.

Most states make it illegal for a company to take your severance if you find another job. Call your states labor board or Attorney General.

Dang I guess i'm lucky then when I got laid off asside from some miss faxed paper work i had no problem getting my severence. and i ended up with 8 weeks and was paid in due time I feel for those who are left behind

Anything other than re-employment at Sears/Kmart shouldn't affect their obligation to continue paying your severance.

If they do have a way of finding out about other employment (e.g. maybe paying for data from large payroll processing companies - I don't know if that's a thing, but it's plausible), I would expect it to take longer for Sears/Kmart to find out and prepare to do anything about it than for the remaining time on your severance pay to run out on its own.

At most companies, it's at least 2-3 weeks from the time you get hired to the time you get your first paycheck.

Part of the agreement I recently signed as my store has closed is that I will inform the company if I find employment during the severance period. Do they have a way of knowing if I am being paid by someone else?

You only get a max. of 8 weeks severance no matter how long you have worked full time, unless you are management.

My understanding was 2 weeks severance for every one year of full time work AFTER 2 years + 1 week. So, i have worked 3 years full time, i qualify for 6 weeks+the 1 week=7 weeks. You have to have worked FULL TIME for 2 years to even qualify. Sorry new guy... and very sorry to old guy who had been a faithful part timer for 30 years.....

I was laid off from corporate in June 2017. They (after many calls & no answers) was told I get 10 weeks of severance pay. I was hourly but a supervisor. No one will give me an email to contact regarding when my actual last date of Severance pay is. The person said email "trasitions@searshc.com"

Seems misspelled to me & emailed hours ago with no response. Can anyone help? Is this even the right email address to get this info?!? Please help!

Question, I work full-time at a kmart in the northeast and many of my co-worker have been let go with a package. There's only a handful of fill timer left. I have also a part time job to make up want hours they cut. Will that affect my severance pay too?

I just went threw that liquidation with Kmart recently. I was a 40 hour a week softilines associate. It is a very difficult thing to go threw. We were allowed to work as many hours as well liked. I am supposed to receive 8 weeks severance pay for 10 years of employment. They pay period is confusing because we're were payed 6 days earlier than the normal payperiod. So I when I called 88sears they would tell me a certain date and it was wrong. Then I was notified by mail that I'm still covered for health insurance so then I was told 21 days after you fax your info to HR. Waiting.

Hourly associates do not get severance, only full time and only with a max of 8 weeks. That is one reason they have eliminated most department leads and cut full time positions and then rehired them at part time.

Salaried get up to 26 weeks max for each year of service. Again, that is why many ASM have gone from salaried to hourly. This prevents them from having to pay severance.

To get severance you should keep on the HR or corporate people. They are in no hurry to pay out money they do not have. It will take some time, usually three weeks but you will get it. Severance is usually 8 weeks maximum for most full time employees.

Everyone who has been Sr**wd by SHC should get a lawyer and start a class action suit. Call your local news outlet and labor board. Raise a stink no matter what. Keep a detailed set of notes and document everything that even remotely seems wrong. Print out corporate e-mails, take not of every violation or labor laws or OSHA laws. Call ever state, local or federal department you can to bring attention to this disaster. Call local newspapers, t.v. news or consumer complaint boards to get anyone to pay attention.

I was a full time Kmart employee from new York. Last day was August 11,2016. I was told we would receive (by mail) information on pension and medical benefits. Have not received anything yet. I can also check by pay by using the same I'd and password I used when I was still working. Did something go wrong with my severance, because it feels like it did

I work for a kmart that is actually closing at the end of this week. Of course the full time associates were told they had to stay to end in order to get their severance packages. I believe about a month ago the full time associates were called into the office and they were told that Kmart had changed its severance policy and it is now a Transitional Pay plan and they only get the transitional pay if they don't have another job or until they find another job up to a certain amount of weeks.

I don't know anybody that was let go getting a good package. After 38yrs I got 8 weeks severance and the 6 weeks vacation I had saved in my vacation bank. We used to get a week for every year up to 20 weeks max. After Sears and Kmart were merged it was changed to a week for every year up to 8 weeks max. I was let go 3/4/2016 on my 38yr anniversary. I was a full time QMT.

Better get a lawyer and start a class action suit against Sears. They will make you sign your life away before they close a store or make you stay until the last day to get paid or get any benefits. If you leave they will say you quit or abandoned your job. So you are stuck either way. You can't look for another job or you stay and work long hours liquidating a store until the end to get benefits. That is why you could not talk.

Doesn't matter is you worked there 40 years it is the same. No loyalty from the company. Everyone trying to cover their a**. Good Luck

I was a soft-lines salary manager, laid off in 2013. I was told a week ahead of time. I was not allowed to speak to anyone about it, or if I did I would loose my benefits. What benefits I asked? It will be discussed closer to your last day. So, I worked my last week and did not speak this to anyone, even my family. The only people who knew was my doom and gloom ex-manager that came 2 1/2 hours from another store to give me the great news. The other persons, my hard-lines salaried co-worker. We did not have a store manager at the time, and had not for several months. So, the day came and I was given my so called benefits package. It was a take it or loose it package and a shut your mouth package. You will get what they want you to have and that is it. If you have never had any write ups, you will be fine. Now, 2 years later, I did survive. It was hard and my family helped me. Good Luck to you ALL.

Full time employees get only 5 wks and part time nothing managers get 26 wk and insurance pd for a year where employees get no insurance paid. Jump ship quickly not worth staying and u can not work while u are getting the package deal. They will take it away from you if u do

I was offered a transfer a few days ago and I turned it down. Now my store is closing but we're not on this list. That means SHC isn't done with this year's announcements. And I found out that I can't reconsider the transfer so now I'm stuck. Anyone else gett offered a transfer? If so, do yourself the favor and take it without question.

From what I've read in the employees handbook (online under 88sears.com), it is one week of pay for every year of service. BUT if I remember correctly, that is only for the full time associates and management. Please read the online version of the handbook in the portal and go to the section for transfers. It should be just before or after that chapter. Good luck to all you associates still holding on.
