Can I request HR file after layoff?

My manager was a nasty little bully and, it turns out, a bare faced liar. Can I request my HR file to find out what he was saying behind my back?

How much do they pay the "HR sock puppets" to monitor this board and post drivel when employees post their opinions or experiences? Enquring minds want to know. The facts are: HR can't PROVE that they are "selfless, kind and talented," because that is strictly a value judgment. HR can't PROVE that they will do whatever it takes to make things right, or that they will address your issues and concerns promptly, because that would involve showing you their abysmal track record--so they will hide behind their alleged confidentiality. Their promise to hold your issue in confidence is empty. Even if an employee originally had no intention of pursuing litigation, if HR believes you might, your file gets sent to Qualcomm's Legal department. If sheep could push buttons on an iPad, they'd be more useful than the HR mannequins.

I agree, HR staff I have encountered have been the most selfless, kind and talented people I have met in the company. I hope they are well compensated for all the bad behaviour they have to put up with from immature and emotionally bankrupt engineers.

In my experience dealing with Qualcomm HR they have been outstanding. Willing to go the extra mile to listen and take action where action is need. Have no fear, you will be happy with the outcome regardless of the situation.

-phs & -vik Are full of sh*t! When I contacted HR about a discrimination issue, I got threatened with termination from my status collector. Quitting was the best decision I ever made. YMMV about the quitting part, but unless something has drastically changed--and somehow I doubt this--the only reason to contact HR is to make sure you have followed any internal grievance procedures required to preserve your legal rights. Don't tell them any more than necessary as they work with Qualcomm Legal to gather evidence they can use to cover their butts.

Yes. You can request your employee file. Send the request in writing by certified mail, return receipt requested. Under CA law, your employer must send the documents to you within 30 days, plus 5 days for mailing.

If you do this, request the entire file--which should include not only reviews, pay history, and time sheets, but your disciplinary record, employee procedural or ethical manuals--if they exist, and copies of any contracts or documents you signed. You generally have at least a year after you leave or are terminated to make this request. One caveat: Don't have an attorney do this.

Yes, even if you signed the severance agreement. Request the file in writing and give a deadline- a week is standard turnaround.
