Its a wellknown loophole. And a lot of my colleagues are doing this to get additional bonus from Intel.
If you have a good relationship with your manager or any other hiring manager, just take the VSP. Chances of Intel giving you free VSP package and rehiring you is very high.

Intel is going nowhere. No leadership, no vision, no responsibility, morale very low. Do you expect any reasonable engineer to innovate? In many cases micromanagement rules. No long term planning anymore.

BK said in January BUM that intel would leave the year with the same headcount as it started... ha ha. Given that they are overturning contested ISPs, acquiring yet more companies, have petitioned for an increase in H1Bs, and hired 6K brand new RCGs/URMs since ACT, that statement might ironically turn out to be true.
It is highly unlikely any VSPs or ERPs will be rehired unless they are an URM. In which case they probably got WARMline support during ACT and stayed put anyway. If you are an OWG, or just plain O, the best maybe you can come back as a green badge doing your old job for half the pay. The ERPers have the chance, after 6 months, to come back as Kelly Temp Services green badges, for example (or at least they did under the old standard retirement package before ERP). There's probably very few VSP/ERP people for whom it would be worth Intel's while or money to hire back at the old, seniority-earned salaries.

Wrong, you should take /n the VSP if you are white, male, over 45. VSP will convert to ISP. It is coming. If you really think Intel is on the rebound and all is well after this first round of layoffs then you really are stupid. Intel is cutting headcount. Every year.
