Unemployment insurance with ERP?

Does anyone know if having accepted the ERP disqualifies you from filing for unemployment insurance in Oregon? The online criteria are murky, saying if employer contributed to or managed any retirement funds, that amount would be deducted from any claim.

Hmmm, I took VSP but Intel HR suggested that I apply for unemployment regardless, telling me to make sure I chose my category/explanation well. I have not done so but this instruction baffles me. Why would they say this if it were to be fraud??

Any VSP/ERP that wasn't forced will be fraud plain and simply, it is clear the State of Oregon has caught wind, better get out of the state and country fraudsters, only ISP with documentation can claim unemployment. Looks like the VSP/ERP are all going to JAIL!

I'm thinking those instances are exactly as you described, OP (ERPs that were let go via ISP). Hence you had NO choice). To me, they aren't really ERPs... they are ISPs that were lucky enough to be given the same package as ERPs since they qualified under one of the various rules to retire.

OP here. No, I wasn't trying to engage in criminal activity or perpetrate a fraud--thank you, trolls, for your ever-cordial and polite concern. I was asking a simple question because the criteria were not clear and because I'd heard of ERPs who had gotten approved. Probably because they were ISPs as well. And yes, my position was eliminated. And, no, getting unemployment insurance does not rip off tax payers, folks. It is paid by the company, not taxes. Just so you know.

kee, you are wrong, if you were offered ERP, took it and then were notified your position was eliminated due to ACT you will get it. And f--- the guy who said you are scamming the system, we paid into that over our careers, you are probably a tax exempt H1B.

I took VSP a few years ago and I had no problems collecting unemployment in Oregon. Just apply. The worst that's going to happen is you will be denied. And do report back.

I totally get that people felt forced out, @-1jnh, but in the eyes of the employment office.... they VOLUNTEERED to leave. They were not pink slipped nor walked out. Now, had they declined the ERP/VSP.... and then was let go.... that's a whole nuther matter..

I do get where you're coming from though, but unfortunately it's pretty cut and dried as to whose decision it was to terminate employment, the "why" doesn't matter.

You are not eligible for unemployment benefits if you took VSP/ESP. That's why those packages are slightly better than the ISP packages. Although ISP can stay on unemployment for close to two years...which is a nice to have.

This round of layoffs from Intel were/are MUCH different than before. I say more to come...but not until 2017

Good point @-wle. I hadn't even thought about the ISP/ERP's, even though I have a friend that got caught up in that one. But, my advice is still accurate. ISP/ERPs HAD TO leave, it wasn't voluntary.

Bottom line... it's not what it's called, it's whether or not you had NO choice in the matter and was asked to leave versus having a choice and leaving voluntarily. ISP/ERP's had no choice in the matter, they just got the ERP after being walked out.

BK and team were nicer than I'd be on that one. I'd have taken the E out of the ERP for anyone ISPed. You can't take away someone's retirement benefits IF EARNED but you don't have to reward them with enhanced benefits. Sorry, that's my take. Good thing I'm not CEO, huh? lol

It depends. If you were an ISP/ERP (Yes, those exist.) Then you may very well be eligible. The amount of money in an ERP package is not the main point. It is if you left voluntarily, and ISPs did not have a choice.

Absolutely correct! If you are forced to leave, you will receive unemployment benefits, but if you voluntarily leave, kiss the unemployment benes good-bye.

Of course it disqualifies you. You VOLUNTARILY left your job. They don't care if you felt pressured in to taking the package, the point is, you VOLUNTARILY took it.

I know this for a fact. I have friend that took a retirement package (from Intel) several years ago. She tried and got denied for the reason I stated above (voluntarily left on her own accord). She thought she was in the right and fought it (again, for the reason I state above ("I felt pressured so had to take it") and it was denied, again. I on the other hand wasn't surprised. You must be let go in order to take it, not voluntarily leave your place of employment.
