Even if there's no suit now, it's coming. Across the entire tech industry. With Intel dropping smoking guns all over the place.
I'm shocked no legal firm has taken Intel on for Age Discrimination. It's so blatantly obvious Intel would be roasted by a jury of their peers up and down the west coast.
There can be no question that the ACT first round was clearly targeted by age. First, obviously, ERP was going to specifically sift out 55+, no way around that. Then, VSP was going to hit those employees who perhaps had plateaued in their careers but were not performance issues--more likely the older you are and the longer you've been at Intel and the lower the grade. They did this around 2012-ish as well with the "blue sky" project, which was designed to encourage retirement eligible employees to leave. In at least one case that I know of where the gray-head target declined, they then built a 'performance' case around it. I remember this employee did an ODI but nothing came of it. And, even then, several retirees told me they felt that they really were being forced, even though that too was called a 'voluntary' departure. If there is an Intel ACT lawsuit around age discrimination, it will have to be from the ISP pool since everyone else was technically a voluntary departure, and we signed away any age discrimination litigation rights to get the package. I do know one ERPer who declined the package but left anyway--that's the sort of person who could make a case if they wanted to. But virtually everyone I know who's left Intel eventually is glad it is over and are not interested in remaining embroiled.
What Intel is doing is so blatant is surprising their is no lawsuit yet. Not to mention Intel is shipping jobs overseas as fast as they can.
