Can a layoff CVX EE work on a CVX project managed by consulting firm

Got my Severance pay in June, Recently I got a full-time staff offer from a consulting firm to work on CVX project. Did any one know if I am allowed to work on this project. Do I have to wait for 6 Months after my CVX termination date? Also, does it matter if the work location is at consulting firm's office or CVX facilities?

Per "Chevron Alumni and Bridges" page, it states that, effective May 1, 2014, HR Policy 305:

Under the new guidance, former U.S.-payroll employees, regardless of pay scale group, must meet the following criteria before they may be rehired as employees or contractors:

· All employees must be separated from the company for at least six months.

· Once rehired, an employee’s work schedule must be less than 50 percent of the average time worked over the 36-month period prior to separation. For example, if an employee worked full time for the 36 months prior to his or her separation from service, he or she may work part time (less than 50 percent) upon rehire.

Exceptions to this rule may apply under the following circumstances:

o If an employee does not take a distribution from the Chevron Retirement Plan, he or she may be rehired on a full-time basis after six months.

o If an employee takes a distribution from the Chevron Retirement Plan, he or she may be rehired on a full-time basis after three years.

If you didn't officially sign a non-compete, or anything detailing prohibited work when you left... then go do what you want. Besides CVX has way more important things to worry about.

Chevron often times doesn't know what the right hand is doing from the left. It's also highly unlikely your new employer will contract you out to work in your former work group or BU, so go with the flow and pay no mind. You'll be working in another business unit where nobody knows you or cares.

CVX internal guidelines do state you have to wait for 6 months before being hired back as an employee or a contractor. This is unlikely to be of any concern to your new employer - only an issue if they are only subcontracting you out or are only an employment agency (i.e. the contract is in your name and they take a percentage off the top). Even then, exceptions can be , and have been, made - just more paperwork to sign by the hiring manager & HR. Normal consulting contracts just specify a scope of work and which consultant's employee does the work is not important (beyond functions: I.e. 3 partners, 1 PMO, 5 programmers & 9 consultants). Don't talk to Chevron, talk to your new (prospective?) employer.

I think you have to wait 6 months regardless of your level and then can only work 50% of the time until the end of three years. Really look into this.

Your new employer knows what they are allowed to do. Don't worry about Chevron anymore since you no longer work for them. If your new employer assigns you to work at a Chevron facility or project, just show up and start working. That's all.

You can not get a consulting contract directly with Chevron for a specified period, but hard to believe you can not get a job with a current firm that goes work for Chevron. If you get a job with one of the major service companies (core lab for example), hard to believe you can not work on a Chevron asset. Then again your not going to get any definitive answers from a layoff chat room...ask chevron: or have your new potential employer ask chevron.
