Thread regarding Oracle Corp. layoffs

New H1B Policy Details -- confirmed with BAL attorneys

Not sure how many people care about this, but I'm gonna share it anyway, just in case some folks may need it:

  1. the 60-day grace period is automatic, you don't need to apply for it or anything.

  2. the grace period starts the day after termination of employment, instead of the date when employer withdraws your H1B

  3. during the grace period if you can find another employer, it will be a simple transfer process, once the transfer petition is filed, you can start working for the other employer.

  4. after the grace period, either you leave the country, or change status (consult visa attorney to make sure you know the potential consequences of this action). With the new status, you can still look for jobs, but won't be able to start working until a new H1B petition is approved.

That's about it.

Best wishes to those who are impacted.

Trump needs to cancel the whole H1B visa program and hammer ORACLE for shipping jobs overseas. They are a big offender.

1000s of existing Americans could be hired into these jobs. Why do we continue to pay to educate inner-city schools kids if we're going to ship or give their future jobs to India?

Only the fat cats at the top can afford to be Liberals anymore.

@LrJyT2H-1ztc once you won "lottery", you are in a "pool". So even if you transfer from H1B to another visa say B-2, and transfer from B-2 back to H1B, you don't need to go through the lottery again. But you do need to file a new petition. With premium processing, a decision can be reached within 15 days. But that doesn't mean USCIS will send you the approval notice within 15 days. You may still wait some time longer. Without premium it could take 5 months to finalize. So if the new company doesn't support premium processing, you should just pay for it out of your own pocket.

Thanks, what do you mean by "until a new H1B petition is approved" ? Does it mean we have to get into the lottery again? Or the previous H1B status can be resumed? Thanks!

Thanks for ur info, the oracle immigrant service is not picking up callings at all! Leaving a voicemail saying best to contact is email, doesn't she know we don't have oracle email account anymore?

It's good the BAL attorneys are there helping all the issues. I suggest calling BAL directly if u need your questions answered.
