Qualcomm wins first round in Apple complaint

It seems that ITC decided to go ahead and open an investigation into Apple... To be completely honest, I did not see this coming... This could be good news for us down the line...

It is really hard for Apple to play victim with their profit margins. Without a sympathy verdict, they will be forced to pay.

Remember that the courts can set the fees if Mav sure over high fees, this happened when Google got Moto's patents and tried to set their own fees.

Apple will still have to pay a licensing fee to Qcom even if Apple stops using their chips. This lawsuit is actually about Apple not paying a licensing fee for IP unrelated to the modem. There's no way around Apple not paying Qcom for whatever phone they make because of Qcom's patents.

Please keep in mind that either way QC will lose, why? Here is why:

  • If QC wins the battle at court, Apple will stop buying products which will be 40% of QC revenue.

  • If QC loses, Apple will pay what they want for the chipsets and then all other customers will follow the model.
