Thread regarding Oracle Corp. layoffs

notice for severance package changes?

I believe the current package provides for 1 week per year of service capped at 26 weeks. Can Oracle change these terms without notice?

We all got your point, but making an idiotic statement that was wrong about involuntary terminations and then suggesting they're going to change their severance package is idiotic.

I am glad people got the package even when fired for performance reasons. My point simply is that there is no legal obligation on the part of the employer to pay it. The employer may be nice enough to pay but not legally obligated.

"Every person I've ever fired through pip got a package. Please make sure you're info is correct." - When we say "fired", the real question is for what reason. If it is for no fault of the employee (like a RIF) then the employer is legally obligated to pay severance pursuant to state laws. If it is for performance or other reasons which is a fault of the employee then all bets are off.

If you get fired and/or you resign you do not get any severance. Oracle (for that matter any company) is not legally obligated to pay severance other than the first 2 months pursuant to state and federal law. So, the 1 week per year of service over and above the 2 months is strictly Oracle policy and there is no legal obligation to fulfill it. Having said that, changing such policies in the absence of financial disaster for the company will result in a PR nightmare, not to mention being able to hire in the future.
