@zzf -- not quite true. There are a lot of qualified Americans and a lot of them apply. One of the problems I see is the initial screen on resumes. People who exaggerate their resume content to precisely match the position get considered and forwarded by HR. I remember one of them being a 7-pager filled with every conceivable tech buzzword imaginable, a resume that would match ANY job. I said we shouldn't interview him because there was no conceivable way he could know everything presented unless he was an inch deep on the content and a constant non-value-producing job switcher. Sadly, a good chunk of these people are non-Americans -- not because they are bad people but they are more desperate and they are following a formula that has worked for others.

Another common fraud often done by Ind managers is that they give offers to their Ind friends, THEN submit job requisition after the fact, just to make it look like an official req.
So who else would they hire? You put in a job requisition. After two weeks, you get ten CVs. Eight of them come from Indians with skills relevant to the position. One comes from an equally skilled Chinese. One comes from an American with some liberal arts degree who has worked in various clerical jobs and who is obviously just applying to every single position that monster.com has to offer, hoping to get at least two or three interviews.
So yes, go complain to the government that the manager isn't hiring the American.
Even IF you could complain to the government about this kind of thing, you would have to provide proof, such as all the CVs submitted by applicants for the position. Obviously, you don't have that, because you are not a manager at Intel. How do I know that? Because if you were, you'd know that it is near-impossible to find qualified Americans.

Reporting to HR always ends up against the the reporting side, as HR is double faced and always suc.s up to hierarchy plus it does not follow most Intel values nor moral ones
I reported 3 separate occasions, including myself, where non-Ind were forced out by Ind manager. Remaining folks are all Ind. ODI case denied.
