Thread regarding Sears layoffs

1st Amendment Rights

This company has gone crazy. Apparently corporate is very aware of this site. Store managers had a meeting today. I'm not sure of the purpose for the meeting. But my store manager pulled me to the side to tell me to stop informing coworkers of the news and information that I research on my own time and resources. He tells me I'm spreading negative news. I had to tell him first you can't tell me stop talking to no one. Second all the information I get is public records. Anybody with internet access can read the same thing I'm reading. I'm sorry not sorry if the information about this company is negative,but I'm not the one making shady deals and transactions. I'm not purposely bankrupting my company. I'm not the one who's going around telling my associates the company is doing good when you have sales decline everyday.

It should tell me something that when you wrote that you had a cook out the other day, I thought the next sentence was going to be that they forced you to cover the kitchen because the cook called in. I thought you now worked in a restaurant. Lol.

As a former employee I can say whatever I like.

I work for a new company now after I walked out on SHC because I was tired of misleading people over the shady 5321 credit promotion and what would happen to their protection agreements if the company filed BK.

Guess what? My new company had a cook out today. And we are having a company picnic next month. I actually get a discount where I work now and I can afford to get sick because I have real AFFORDABLE benefits.

And no one makes me feel like my company or facility is going to close because of me.

I had forgotten what it was like to work for a company that didn't expect its employees to pay the price for mismanagement and greed.

It's time to quit lying to the customers, dust those crappy stores and cubicles off your feet and get away from that toxic worthless company.

If you are waiting for your severance, look at Sears Canada. And if you are hoping to get your pension, look at Sears Canada.

SHC certainly is not loyal to you.

Its one thing if you blast them on social media yet here management doesn't really know who it is. They know the company is going under but they want to block associates from knowing what is happening.

If y'all don't believe you can't get fired for putting your employer in a bad light, even if true, y'all are in for a big surprise one of these days. People get fired ALL THE TIME for things they do off the clock that puts their employer in a bad light.

Op here... I don't go around badmouthing the company. What I do is show other coworkers different websites to give them the state of the company. Some don't understand most of the lingo so I will break it down for them. I state facts. Example yesterday coworkers didn't know he gave the company a 200 million dollar loan. I just explain to them how the loan work. Anything I show them I tell them I just read different articles and kinda understand what's going on. I don't have my head in the sand and act like Sears is making money hand over fist.

Corporate does monitor this site. Corporate does post comments to downplay the negative truth. Corporate is very hip to what is being said, and makes attempts to disclaim the so called "whistle-blowers.

This is exactly right. And it doesn't matter if the speech happens on or off the clock. Although an employer can't stop a employee from speaking freely, they aren't obligated to keep the person employed. I've seen a lot of misconceptions on this topic over the years. There aren't many limitations on the right of employers to fire people.

That said, it is rather pathetic they waste time beating up employees over this kind of thing. The situation certainly isn't going to improve just because employees quit talking about it.

Stating a fact without opinion is not putting the company in a negative light. They cannot force people to lie even if it is a lie by omission.

A private company can fire someone for badmouthing their company but our freedom of speech allows one to speak the truth. Do not be intimidated by Sears.

The first amendment is a protection from government limiting your speech, not a private entity. A private company can set whatever rules it wants to about employees putting the company in a bad light. Having said that, it s---s that they try to control what you say. But the fact is using the first anendment as a defense doesn't fly when it's a private entity.

What do you mean corporate is aware of this site? Corporate posts on this site. This site is for all associates....not just store associates. It is also for associates that both like and dislike the company.

Actually they can't stop someone from stating a fact.

For example an employee can say, "I read on the Layoff site that Sears will be bankrupt this year. don't know if its true or not but according to the message boards a district manager stated that information. You are welcome to read it for yourself at the layoff.com."

They can tell you not to make up rumors but they can't block you from speaking truths.
