Thread regarding Nike Inc. layoffs

Age Discrimination - Class Action Lawsuit

I may be completely off here but judging on long tenures folks are reporting on this site, there may be some legal irregularities here as it relates to layoffs. I believe Nike would have to disclose ages of folks who are eliminated and if we notice that the majority of folks laid off are over certain age (let's say 45 or 50) we may be able to start a class action lawsuit claiming age discrimination. Would any of you be willing to learn more about it? I am not looking for commitments, just exploring to see if there are more like-minded people who think along these lines. Please respond.

It won't go anywhere. I was laid off in 2017, clearly discriminated against, and tried to get on with the class action suit and the attorney told me that since I signed the layoff agreement, they couldn't represent me. ...and it had nothing to do with not having proof of discrimination. I had plenty of emails and salary proof.

Have a friend that worked for Blue cross years ago, said Nike lays off older workers as their insurance costs them more. Is it a coincidence both my 2nd cousins husbands got laid off from Nike several years apart as they approached 50?

Nike gave a list to those that were laid off (I think visibility went to E-band+) outlining positions within your function and the ages of everyone who was retained v laid off. They clearly think they have done the work to stay in the clear of any age discrimination lawsuit. (Not cool to reveal ages of people, though. Isn’t that a breach of privacy?)

I was hired as a contractor to help get rid of an older woman. There was nothing wrong with her work. It was disgusting. Firms keep calling me back to work as a contractor for Nike and I'd only work there if it was my last option, even if the pay is good. I hope she sues the bejesus out of them and wins.

Some Male bosses perfer younger female staff hire all their friends -that are allowed to talk down to employees that have been there 10 years or more at Nike. No equality there it's a farce!

Know of bullying tactics used to intimidate you. They state equality and don't live up to it! If you're over 45 or have been there 20 plus years your chances of getting let go? = 80%

I spoke with a person from the EEOC. She explained the process and was realistic about expected outcomes without being discouraging. She told me they are looking at this site everyday and have posted here too. They are interested in the number of older employees fired this year. They have received a number of complaints already. I decided to go forward and file a complaint. I encourage you all to do the same as soon as possible. The more the better. There are legal deadlines. Give them a call or read the details on their site. It matters whether you are a U.S. citizen or a foreign worker. The EEOC talks to lawyers everyday and will make referrals. Don't settle and don't give in to the fear.

If you believe that you have been discriminated against at work because of your race, color, religion, s-x (including pregnancy, gender identity, and s-xual orientation), national origin, age (40 or older), disability or genetic information, you can file a Charge of Discrimination. All of the laws enforced by EEOC, except for the Equal Pay Act, require you to file a Charge of Discrimination with us before you can file a job discrimination lawsuit against your employer. In addition, an individual, organization, or agency may file a charge on behalf of another person in order to protect the aggrieved person's identity. There are time limits for filing a charge.

My job was not eliminated as I was told. I was replaced by a 27 year old.

I am interested in pursuing this class action lawsuit and I think there will be others who will want to join us.

It would be great if a lawyer could reach out and post contact info. As of sept 30, any of us laid off will have signed our agreements and waived any rights to sue. Any of the June layoffs would have already done so.

I'm sure many that got laid off want to POST and volunteer their entry! However, their severance (health insurance) is in jeopardy. Keep your mouth shut until October! Then ban together. Lawsuits against OLD PEOPLE will look real sh--ty and wreck the swoosh! PATIENCE will prevail. The lawyers are waiting... you should too.

Look at Yelp and you'll notice that there are many attorneys specializing in this area (just in Oregon)...

There must be a reason for all of them to exist.

Pick a couple attorneys, do some phone calls and see where this takes you. If they work on a contingency fee, there is very little to lose.

Don't listen to the person saying "drop it". That's exactly what Nike wants you to do. Nike has an army of lawyers true, but there are just as many law firms who'd take up a class action suit. At least in the discovery process, Nike would have to give up documents showing who they laid off, from there we'd know for sure if there was any wrongdoing.

Of course you stand a chance. Sure Nike can hire lawyers, but so can the employees. Especially if there are a lot and it's a class action. Don't give up your legal rights or accept abuse because the fight is hard. That plays into the hand of the abuser.

If you think you've been discriminated against based on age make sure to first make a claim with the EEOC.
