Thread regarding IBM layoffs

IBM wants to cut employees without paying severance.

This just came to my team (outside the USA). They ask you to choose between agreeing to come back in or voluntarily resigning. If you agree to leave voluntarily you of course don't get a severance package and where I am you won't qualify for government unemployment benefits either.

The law here also states that if an employer makes a major change in work conditions (such as work location) WITHOUT employee consent and make that a condition of employment, if they let the employee go for not agreeing to it then it is a 'constructive dismissal' and they have to treat it as a layoff and give severance. Of course nothing from IBM lets you know this, they want to cut employees without paying severance.

If you work the PIP and they fire you, you get nothing. If you accept the 30 days and 90 days of benefits IBM will report that you quit and you will be denied unemployment.

Same here in Spain.

I'm now being forced to enroll into PIP, with deadline december the 31th. Of course, the will try everything in their hands to avoid paying severances. They tried a similar method last year (career center, where you followed a course to be reallocated in other company).
