Walmart to be sued for age discrimination?

The below was posted in another thread. I am not the OP but I thought it was worth putting in a separate thread in the event that it is true.

Just something to think about in the event you get laid off. If you take the severance, I don't believe you can sue. If you believe age discrimination is happening, you may need to start documenting stuff before they lay you off. Find a lawyer before you sign to see if you have a case.

Maybe the OP will share the lawyer he is using? If the case is being taken on commission, it can't hurt to explore can it if you're already out of a job?


You are so correct. My Wife and I were both displaced for no reason. No performance coaching, good reviews. They called it realignment and job elimination. Someone I worked with in the department said that leadership waited until everyone had signed their severance and then replaced everyone with people in their 20's and 30's.

I heard from a friend of mine who recently attended a Walmart Town Hall that one of the presenters asked how many people in the packed Home Office Auditorium had kids going back to college, and no one raised their hand. It's because no one in the room was old enough to have kids in college.

We have retained an attorney who is working with a class action Law Firm from Denver. We need to lower the legal hammer on these greedy Executives and nail them with an age discrimination Class Action Lawsuit.

It's not just age. It's people with disabilities too. There never used to be available Handicapped Parking spots but drive past the Home Office and you'll see there are plenty of them available. Why? Because they got rid of people who don't look like the people who sit on Executive Row. They let people go who were on protective FMLA Leave too. People recovering from Cancer, or injured on the job. Evil Corporate America. Congratulations Mr. CEO. You're going to go down in History as the Man who killed Walmart. I'm sure you'll sleep just fine with your millions in the bank.

@1sru - If you didn't take the severance package, then you are a fool.

@1iyt - There's not going to be any class action or other suits that would prevail in the courts.

@2wqo - The situation in Wisconsin is an isolated case based on their reading and interpretation of the ADA and the fact that an accommodation had been given for so long. Walmart will probably settle, rather than spend money and effort litigating.

@2hpc - You are exactly correct. Before a resource action is done, careful scrutiny as to age, ethnicity, gender and other factors are carefully considered in order to avoid any pretense of discrimination on any lines. It's extremely unlikely they made any mistakes, Walmart has tons of lawyers pouring over these plans as well as outside consultants.

You do know that Walmart purposely displaces a variety of ages in mass layoffs so that they can't be sued right? Good luck withe the lawsuit.

I have been with the company over 25 years with great job performance and was displaced. My district was outperforming 75% of the others in KPI. I will be consulting an attorney. Difficult to understand for a company that has always claimed "our people make the difference" Until they don't.

We read the Severance and considered it a "Get out of Jail free card" for Walmart. We told them to Stick it! They could keep their severance and we didnt sign anything. There are a lot more dumped associates than they want to think about that opted not to accept the Severance because we know they were breaking the law.
