Massive layoffs in the US will take place in the month of November. Here are some key things you can do to make it more difficult to terminate you and extend your time:

  1. File a compliance case - if you are aware of a compliance matter or feel you are victim of inappropriate actions, file a case ASAP. They will not be able to terminate you until this is resolved. Of course, this needs to be truthful.

  2. Family Medical Leave Act - if you have a serious medical condition that is being flared up by the current state of affairs, go on leave. Most salaried employees will be out on full pay and they cannot give you a layoff until you return.

They can notify you of your layoff while you are on FMLA leave and they don't even have to let you finish you leave. They just can't lay you off BECAUSE you are on leave . If they eliminate your group or your position it is no issue if you are on FMLA. I know women who were notified days after having a baby. They did get their FMLA 6 week pay still plus the severance.

I didn’t read this post as suggesting to be unethical.

Reality is decisions to lay someone off are not always objective and relationships and perceptions prevail.

If legitimate I think this is a prudent thing to do.

After all, the company doesn’t care about you
