Thread regarding Sears layoffs

Sears wants us to work for free

At my store we don't have a lot of people who want to work or are any good at it, so the few of us that know what to do end up having to do everything, that is and isn't our job. Yet, they still scheduled us just under what is required to make us full time. Can't tell you how many times I'd clock out and then get called back in off the clock just "for a minute" that turns into an hour at least. I'm sick and tired of it. When I ask for extra hours they say there are none, yet there are things that have to be done and they expect me to gift them my time to do it. If they don't add extra hours for the holidays, I am planning to get sick. I don't even care if they fire me anymore.

Let's look at this from a positive point of view instead of thinking everyone is out to get everyone else. Maybe your manager didn't know you clocked out? I don't work in the stores, so I don't know, but simply tell him/her hey I already clocked out. You need help I will clock back in. And then say nothing. See what he/she says.

I work at a HTS. Don't fall for that crap!!! No is no! Either clock back in and make them pay or they are sol. I did that so much that I burned myself out. 3 years of bending over backwards thinking it was better to show reliability than take care of me. And now as a, and get this, manager who is part time (less than 40 a week), they scream because I either go over hours because I don't work for free anymore or I refuse to help because they don't want

to pay overtime.

Sears themselves even got hit with this just a few years ago: https://www.chicagoovertimelawyerblog.com/2014/10/647.html

Maybe you can surreptitiously leave some printouts of that laying around the back rooms...

happens here all the time...i made the mistake of giving in once, never again...but we do have a few people who are so scared of losing their jobs that they always stay if somebody calls them back... not sure for how long they stay off the clock, but they do...i have seen it happen a lot of times...

Honestly this is just stupid. Either leave or punch back in. Either way, YOUR choice.

Not BS. In our Sears store they did this to some employees including me. I refused, told them I was off the clock, and walked out as did someone else. One employee caved and stayed for almost an hour. You can't let these guys intimidate you.

I'm calling bs on this. The one thing this company is good for is covering their a--. No one is asking you to work an hour off the clock. It's VERY simple, clock back in or walk away. Really not buying what you are attempting to sell us on.

OP stand your ground if you clock out your done. You can answer a question (up to your discretion). If they still need you tell them you can't your off the clock unless they let you clock back in to work. You have the upper hand here they can't threaten you, but you can you can tell them this is illegal to work off the clock and oh boy they will leave you alone because this can be a law suit that can cost them some $$$.

Simple solution: when asked after clocking out for another few minutes -- CLOCK BACK IN AND document document document as who asked when asked why asked --- dont get paid take to State labor board !!!!!

Stop being such a pushover. Literally all you have to do to avoid half of this rant is say "no". That's it. That that's all you have to do... all you have to do to get more hours is to start looking for another job. You don't have to quit before finding another one you're you know. Hell, you can even work both and work more hours at the new one while still working at sears. Let them keep their hours since they're in such high demand.

I feel for you, but the only reason this has been happening for at long as it has been for you..is because of you.

Yeah if they pull that kind of b---s--- you need to leave as soon as you clock out and threaten them that you'll take them to court or at least leak it out to your local news media.

When you punch out start walking to the door. If someone calls you back say" I'm sorry I'm off the clock and I have things to do". Tell them to catch you another time when you are clocked in.

I call BS , no one will ask you to work off the clock, yes maybe come back for a minute to answer a question, but to stay for an hour ... no way no how .. if you do your stupid. If a manager does this even once and its reported to 88 sears he/she will be out of a job

That's illegal unless you are salaried. Keep copious notes and start looking for a new job (you should be already.) When you leave, give them your notes demanding back pay for what you have documented. If they they still balk, go to your states' employment commission.
