Commission issue

Why haven't you commission sales people started a class action lawsuit? Taking you away from sales and negatively affecting your bonus chances with softlines driving down your metrics is unlawful if they profess to pay you commission.

Any chance there is some truth to this being unlawful? I'd be first in line for a lawsuit if this is the case.

@Qvrr9XV-hlz Yeah, I’ve thought about that, but I’m thinking Chevy’s. I’m pulling down very good money at sears. I’ve been here 33 months and xmas is so good to me. I’m actually making more than I could at hooters even accounting for so much of the tips being tax free.

Joe six-pack seems more likely to open his wallet and not expect me to open his fly in return. Rich people who came in to Hooters were always lousy tippers and thought they could grab u by the Pu@@y, u know what I mean?? Complete pigs. The men here want the same thing but they’re more generous and don’t feel like they can force themselves on you, like it’s their right. I dumped a pitcher of beer on a guys head one time who grabbed me. Such a douche. But I couldn’t imagine doing that to anyone at sears. The weirdest I’ve had here is one guy asked me to sit on the washing machine in my skirt, so I did. I thought he was gonna pass out right there when I slowly crossed my legs, lol. Sometime he stops up during the week and brings me lunch and asks me some nonsense questions about the new smart appliances. I always put a good show on for him. It’s paid off he’s sent some of his friends to buy.

Yup. The job description is just vague enough to allow additional tasks to be asked of you. Morally there are rules that most people/managers follow. Legally they can tell you to do whatever they want and legally it's part of your job.

Take a close look at your COMPLETE Sears job description and I don't mean just the one in the computer. I mean the one a company uses in a courtroom or other legal setting if you can somehow get a copy of one.

Buried in the fine print somewhere will be terms like "additional tasks as assigned" "other responsibilities as needed" and other terms and phrases that mean the same things. It's boilerplate language you eventually find in 99% of all job descriptions. I know. I spent 13 1/2 years in HR with another company. I sympathize with the commissioned salespeople who get stuck ringing non commissioned items. Unfortunately, Sears doesn't care. Hang in there.

Ha, Ha, Ha. Class action lawsuit. Really? IF you want to go that route you had better be ready for your life to be turned upside down. Have you ever taken a long break. not done some aspect of your job, come in late, left early, been written up etc. If so they will bring this up on everyone who may have done this and also they will look into your personal life, your social media post and also they will track you down on any and all searches you have done. And not just you but anyone else who may want to go this route.

Also, you have to have a boat load of people to file a class action and in the end even if you will 10 million dollars, after legal fees and any appeals and the split between the numerous plaintiffs you may walk away with $2.50 cents.

Just look at any class action suit, unless you are a primary plaintiff you get very little.

@dkx Hey, just a thought: when the time comes for you to move on, new car sales positions might be worth applying for in addition to appliance sales at other retailers. I could imagine you making bank at a luxury brand dealership.

It would be nice but it wouldn’t work.

I was a waitress at hooters and we tried something like that, they fired some of us for trumped up stuff and then closed the restaurant.

Now I ended up here selling appliances, the customers are way nicer, I tell them about my old job, they buy appliances tell me about their wives in their mom outfits you know baggy sweats etc say sweet thing s and give me their money. I’m not getting any younger but at least I’m not treated like an object anymore. The managers are all douches, the female ones are jealous and the men are constantly staring at me or coming over and rubbing my shoulders telling me how hard I work, asking me out for drinks afterwards or to lunch or to smoke outside. I could do a s-x harassment thing but I enjoy the attention and if they touch me a little it’s not the end of the world

Get the money while u can girls, the place is going under so just enjoy the ride. A lawsuit will get you no where.

Your company changed your compensation structure, as was their right. There is no contract that says they have to pay you commission. they made a choice. You have a choice too.

Class action lawsuits take multiple years to work their way through the court system before anyone sees any money from them, even if they are/would be eventually successful. SHC is unlikely to still be around by the time that happens.
