Thread regarding Sears layoffs

Severance, Unemployment Insurance and SHC (illinois)

So I was let go Feb 23, 2017 (yes last year). Today, 1 year later, I get a Notice of Audit from the State of Illinois that I was not entitled to Unemployment. I call the assigned caseworker and end up talking to a nice guy. He asked if I have a Severance Agreement from SHC. I said Yes. He tells me to send it to him because "Sears always does this. They are trying to get out of paying the state their share". So keep copies of your agreement and expect to be on the bad end of more SHC Transformation 12 months later. Thanks for the 37 years. You'll be hearing from us again a year from now...

I am sorry I posted that I did not get my UI, until my severance ran out, that was wrong. I was given my severance as a weekly paycheck, and when I did not get my severance, I received my UI benefits, sorry for the miscommunication. Thanks, Tulsa, Oklahoma

@3dvy Thank you! There is so much incorrect info on some of these posts. Really it falls on the individual who was laid off. It's awful, but it is how it is. Read and ask.

3zsx is right. I was unemployed in Michigan 12 years ago and got a lump sum severance. I got unemployment the whole time that I was between jobs EXCEPT for the week that the severance was paid. But I know someone else who lost her job when Mervyn's closed (remember them?); they paid their severance out weekly and she couldn't get UI until the severance was done.

You have to do your own due diligence.

Read up on your states laws as it varies from state to state.

@2bge You are right. In California you can file for unemployment while getting severance.

Wrong, you can file for unemployment while getting severance.

I think that could be it.....you file for unemployment after the severance is done. You are still on the payroll until your severance is done.

My store closed last year, I had no problem getting my severance and unemployment benefits. My severance came like a regular paycheck every two weeks. I filed for my unemployment benefits, when my severance was up. I am from Tulsa, Ok., may be someone did something wrong with your paperwork.

When our store closed we had the same problem. State said that SHC was a pain to deal with and they would not send paperwork on time or give excuses to not pay unemployment. Talked to a lawyer and he told me that the State AG is thinking of brining a suit against SHC. Dont know how true this is but seems like states are tired of SHC b.S. and are taking action.

@ighp - You obviously haven't experienced the thrill of being kicked to the curb yet. SHC will omit paperwork, lie about receiving documents, delay paying severance, and attempt to short the total payout. Ain't nothing sacred with those bozos.

I don't live in Illinois but I fully believe they could do this to anyone in any state. I'll expect a similar call my my state unemployment people in a couple of months. Thanks for the heads-up.

It took a whole year for Unemployment to reach out, I think someone in Unemployment f---ed up. Believe me not trying to defend Sears, but I had no problem getting unemployment from my State, and they make contact with your employer. Maybe Sears neglected to send paperwork, but they didn't do their part as well. Sears did file an appeal, but didn't show up.

It’s because they file an appeal for every unemployment claim. They are hoping you don’t follow through

I know that's harsh, but minimum wage, no raises, no incentive to work for Sears. Give back to the people who slave for you being so short staffed and over worked. Don't just care about the real eastate...

Thanks for letting us know. One thing I know about this company having worked corporate for many years is that they will do anything they can to make a buck even if that means causing you an injustice. The company despises its workers and it shows everyday in the companies actions and inactions

@RV2eRWo-1ghp It is indeed hard to believe, but I coming from Sears I believe its possible to be truth. When hasn't Seared screwed over a customer/employee many times. Maybe they expected OP to just get his severance and forget about the unemployment who knows.

That seems hard to believe. I am sure it was just a matter of a form not being sent by Sears or something?

I'm happy you reached a good guy. And I'm sorry Sears did this. Thanks for the heads up.
