Thread regarding Walmart layoffs

Performance based layoffs???

The company appears to have decided to do a pile of cutbacks and are claiming "performance" as the reason, not for any restructuring or realignments, HR said the federal WARN act doesn't apply. The were quick to point out they were still giving 1 additional month as a full associate, and if you sign an agreement (who knows what will actually be in it, probably signing away your right to sue for age discrimination and to not say anything negative about the company), they will give you a few thousand dollars.

Why would the go the cheap route and attempt to bypass the federal WARN act? They are playing with fire and a class action lawsuit. I doubt I am the only person who was told this today, and no documented performance reasons and I haven't received a bad review ever. Seems very strange

By my manager's metrics I was meets but got pushed down to partial in calibration. I'm probably screwed too.

If you don't know how you are doing until the end of the year, your manager is trying to make you fail or at least allowing you to fail. This gives the manager an easy person to rank low and they avoid the work of trying to develop their people,

Wow. I was called in 2 weeks ago and said I was given a ‘Needs Improvement’ during a mid year review. That was news to me especially when details could not be provided.

I get now what they what they are up to.

The way they are going about this will leave them open to litigation if these allegations are true.

If this happens to me, I will seek legal representation and wont sign anything in haste.

@Ro8HOwp-1qxu It's definately cr@p, but WM has a nice little disclaimer on it's coaching for "improvement" policy that says sometime to the effect that there is no contract of employment, at-will- employment...blah, blah,blah.....and that they can modify that policy at any time for any reason. Unfortunately, I'm pretty sure that covers them legally.

So Walmart has policies in place relating to the firing or termination of associates and they aren't even following them? If they can't provide documentation that verifies that your performance is sub-standard, how can they say your terminated due to performance? Seems to me that a lawyer "out there" would be jumping on this and filing a class action lawsuit. I know two associates that were fired and when Unemployment found out that Walmart didn't follow their own guidelines, they were immediately approved for their benefits.

If you have been laid off based on performance and had no prior notification that performance was an issue, I would hire a lawyer.

I’d also go to the newspapers. Don’t sign anything.

Even if you do sign a document and accept the money - you do all realize that you can still participate in legal action?

If Walmart violated federal law, they can’t enforce a contract based on illegal action.

That would be as if you signed a contract “allowing” someone to kill you. Killing is against the law regardless of the contract you signed and that person would be persecuted to the full extent of the law.

Doesn’t matter you can have a spotless performance record they don’t care. Again here is how it goes.

If u are over 40 you are gone

If u are a white male you are gone

If u are g-- your job is safe

If u have 20years in u are gone

If u are a black male u are gone

If u are a unattractive woman u are gone

If u are an attractive woman your job is safe

If u are related to or are banging anyone director level or above your job is safe

If you don’t sign you don’t get the severance - I doubt anyone is willing to do that .

If 60 days paid notice is given, the warn act requirement has been met. Perhaps some confusion on HR's part?

What this will likely do is block the chance of rehire, if a rehire was an interest on your part.

No, they were quite clear the federal WARN act didn't apply with myself also, yet I didn't have a bad review. My advice to people is do not sign this and be clear this is a violation of federal law, and find the right federal agency to contact. A few young attorneys who want to make a name for themselves I am sure will be organizing some sort of class action status out of this

I may be wrong, but it was my understanding that they keep the displaced on payroll for 60 days which is effectively fulfilling the WARN act requirement. They give you 60 days notice before you are technically terminated. You may be prevented from coming into work or accessing systems, but as long as you are on payroll WARN is satisfied.
