Thread regarding Qualcomm Inc. layoffs

Has QC posted a WARN notice?

I heard layoff numbers between 3000 and 4000 employees before Tuesday. Doesn't a WARN notice have to be posted when numbers are that high? Last layoff were within that range and a WARN notice was required. Does this mean the layoff isn't happening?

due the trend of business friendly governments (read governments that allow firms to bend law and break law) world over, these things are not going happen.

In India the business friendly modi government allowed companies 200000 employees to be fired by forcing them to resign not tht the IT compnaies faced difficult time in market, but to just boost profits margins . It is even allowing CEO and promoter of companies who committed large scale bank frauds running in biliions of dollars to escape the country unhindered.

AGGREGATE EMPLOYMENT LOSSES WITHIN 90 DAYS?

Fed WARN: Yes. Employment losses within 90 days will be aggregated to meet the definition of a triggering event unless the employer can show that the losses resulted from distinct causes and were not an attempt to evade the statute’s requirements.

CA WARN: Uncertain. Cal. WARN does not expressly call for 90 day aggregation. This is an uncertain

area and employers should consult counsel about aggregation under Cal. WARN.

Employers must give a WARN notice at least 60 calendar days prior to any planned plant closing or mass layoff. When all employees are not terminated on the same date, the date of the first individual termination within the statutory 30-day or 90-day period triggers the 60-day notice requirement. A worker’s last day of employment is considered the date of that worker’s layoff.

WARN requires 60 days notice, if Qualcomm gives every employee a least 2 months pay in addition to severance, that should suffice as a 60 day heads up at the time of notice. Unlike before, employees will must likely exit within a few days of termination notice and not hang around for two months.
