Age Discrimination - Legal Advice?

I know that often times older employees translates to higher pay scales and bonus levels, but when it's a glaring pattern is it still that hard to prove it's discrimination? I'm curious if anyone has reached out for legal advice on the topic and can share any insights.

Always good to keep in mind a company HR dept. isn't paid to represent YOUR interests/issues. That's why HR stands for Human Remains. Sad, but true in my experience.

It is important to know your rights and DO NOT rely on Cisco for legal advice. Cisco may tell you that you must sign away certain legal rights in order to receive a severance package however certain severance benefits may be mandated by law and owed to you regardless of whether or not you sign an agreement. Cisco is looking out for Cisco's well being - not yours!

@S4xHTvs-1zux - The reason we say things like that is that the young idiots keep making the same mistakes that we've seen before many, many times. The newbies with their JS library of the week - you can't learn the latest before it's obsolete. So we just roll our eyes as the next generation learns that they don't know everything

It seems to be getting harder and harder to have a meaningful discussion on this website. To the person who asked for legal advice: If you feel you have a legitimate discrimination claim, contact some employment attorneys for advice. (Get more than 1 opinion). Be clear about what it is you want to accomplish and what your situation is: Are you trying to maximize the $ you walk away with? Are you trying to take a stand against illegal labor practices? What is your financial situation? Are you willing to take the time to collect data and document your case? There are different things you can do that will have different costs and different potential outcomes. Many people (like on this thread) will tell you that it is not worth it to take any action at all - only you can decide this for yourself - but what makes you think that you are not going to be discriminated against again if you and others don't take steps to help change perception that it is ok to do this?

Old people move slow and are stuck in old days at cisco. If I had penny for every time SE or sales guy say "I remember tdm voice and ATM" or some such thing I be rich. Time to moves them out. They cannot code and think python scripts make them cool or coders or relevant after taking some lame trainings. Not close.

Most, if not all states, have an agency that handles discrimination complaints at no cost to the person filing the complaint. In California this is the Department of Fair Employment and Housing (DFEH) https://www.dfeh.ca.gov/ It can take years before these agencies can act on your complaint - they are really backlogged - however there are groups including the U.S. Department of Labor that are monitoring this data and investigating Cisco and other companies based on these complaints. I know this because I have filed a complaint and I was contacted by the Department of Labor who wanted to know the details. Does this get you extra $ when you lose your job? No, but you can be assured that discriminatory practices will never change unless people keep raising legitimate cases of discrimination in the right forums. Cisco and other employers bank on the fact that we won't do this.

Agree with S4xHTvs-dhf even though HR and management methods are extremely underhand and definitely discriminatory.

I was advised that I'd probably win in court because of the behaviour of my VP but the payout might not be any higher that the package on offer. You should also consider the stress, the chance that you might not win and the fact that moving on quickly will have a positive impact on attitude and probably make you happier.

It might be worth talking to HR and see if they have room to improve. Your will be met with a firm no but try pushing, you have nothing to lose.
