EEOC - go on line and file for interview NOW, let the government know your concerns, even if you’re still working, to report discrimination and violation concerns. This is one of the few ways we have to get outside review. The first step is to file for an interview at which time they discuss with you filing the complaint.

SF has been putting an increasing squeeze on people (older employees) to get them to quit or retire earlier to reduce pension liabilities and severance costs intensely for the past five years and even more significantly in the past two years. We are like lab rats in their grand experiment to see how much we can take work load wise before we leave, or get ill, or die. They are targeting older employees, and people who used sick leave or family leave previously, among other things.

They may use any of your “one on one” meetings as documentation on your recommendation for termination memo even if you were just discussing approaches on file handling. They can exaggerate on the memo taking a few files with late calendars and making it seem like a hugh trend.

There’s is no guarantee they will offer severance to your work group. Unless you have it in writing I would not take it as a given. Don’t sacrifice your health to try to hang on.

It is a very hostile work environment. Please do not lose your health or your integrity.

They have changed the company culture. Some in management are sacrificing their character to keep their jobs.

It is a sad time at the farm. I like the quote that goes something like: forgiveness takes one act on one day, but anger/hatred takes every day. Let it go, move on. There is life after SF. Bottom line is they don’t care and unless the EEOC and or a class action lawsuit comes through there will be no repercussions or change in behavior.

The age discrimination is real. Whether State Farm has managed to skirt the law successfully is a matter for the courts to decide, and I suggest those impacted take it there.

I know several younger people who took voluntary severance. In every case, they were told some variation of, "No, don't take this severance. This isn't intended for you."

So you have to ask yourself, why would the company OFFER severance to people that it DID NOT WANT to take it? The only logical reason is if NOT doing so would create a legal issue for them, and the only way that makes sense is if the people they REALLY wanted to take the severance were members of a protected class.

I'm certainly no expert on whether one can came age discrimination while simultaneously opting out of the company in exchange for a larger payday. But what I am certain of is that the people SF wanted to leave were identified in large part by their age. Combined with all the stories on this site from people who felt pushed out by targeted management practices (particularly in claims), I am left with the impression that there may in fact be a lawsuit here for those with the patience for it.

The people being terminated or pushed to early retirement or quitting prior to severance don’t sign an agreement. File with EEOC. Let the government investigate.

That website in the previous post has some eye-opening information. It seems the labor laws have relaxed quite a bit as they pertain to the older worker getting laid off. And if you take the severance you basically sign away your rights to pursue them legally. So you can take the six months or 12 months severance or take nothing and file suit hoping for settlement. People need the money now. It is amazing how the company is today versus how it was 20 years ago. I hope everyone comes through this OK but I know that is just wishful thinking.
