Had BK not sold, stock price would have been more compared to its current value...
The legal test is not whether monies were gained or lost, but solely whether there was a potential for a gain as a result of a trade executed while in receipt of material, non-public information.
Doubtful BK is going to have issues with his insider trading tied with the meltdown/spectre issue. INTC stock went up afterwards, so BK lost money by selling early.
