Thread regarding State Farm Insurance layoffs

I'm going to say it

You know I do feel like the company owes us. The company is great because the employees made it great. When I started 30 years ago, it was told to me the benefits and pension offered and I stayed for those things and now it's going to be taken away. So yes, I think they owe me. Had I known the benefits would be taken away or i'd get screwed out of retirement I would have left and went to work for a better company years ago. So yes. They owe me and us. And here is what I think about the changes. If they have to be made then freaking do it the right way. Offer all employees voluntary severance where they get a little more money to help them during this transition and freaking yes, say to them I'm sorry but we have to make cuts and here is your voluntary severance. SF CAN AFFORD TO TREAT THERE PEOPLE RIGHT. THEY CANNOT AFFORD NOT TO. We are trying to help you transition all we can. And give everyone the courtesy of AT LEAST 1 year notice. After all the employees made this company successful. It would have cost Sf far less to have paid everyone voluntary severance and given at least 1 yr notice. Any xemployees would have Said sf treated me right. But now all are saying how Sf screwed them. This will no doubt hurt the company's future and reputation. And that matters for the company's future.

Not true. They owe him everything he's already put in the hours to earn, which does include the paycheck, but also includes previously earned retirement benefits, health benefits, vacation days, and so forth. As was mentioned previously, if the retirement fund is liquidated tomorrow, they still have to pay out.

They also are not allowed to fire people simply to get rid of their retirement accounts, per age discrimination laws.

Very few companies even offer a retirement plan these days. Am I understanding correctly that new hires at SF will not have any?

My outlook is a bit different than yours, but anyone who comes to a website like this one to talk about how those who are dealing with the emotional turmoil of being laid off are tools of the highest order. Losing a job is right up there with divorce and death of a loved one in terms of the emotional impact, so we're all entitled to be a little angry, whether it's rational or not. And quite a lot of it is rational.

My take is that the company can do whatever it wants with regard to benefits that we have not yet earned, but it is legally obligated to fulfill promises made for services already rendered.

That means it cannot legally take away pension benefits that we've already earned. If it liquidates the trust, it would still have to write us a check for the amount owed today. This is not an emotional appeal -- it is a fact.

It also means that the company cannot fire you just to ditch the salary of an older worker with higher pension benefits (those age discrimination laws exist for a reason).

Now if the company wants to freeze the pension and liquidate the trust and switch everything to a more competitive 401k, that's well within its rights.

But like many others, I feel like State Farm is trying to have its cake and eat it too. We'll see if any legal disputes arise from it.
