Thread regarding IBM layoffs

For those wondering why 90 days vs 2 weeks...

The RA for Sales was based on PiP aka not delivering on quota/plan. They effectively used a sales-related reasoning to terminate for cause. When moving the tech sales team to team quota plan aka pool plan - tech sellers are no longer responsible for specific accounts and quota so therefore you cannot use the same mechanism.

Now why 90 days?

This is due to the WARN Act specifically those ou in the State of NY and CA. If you trip specific metrics for mass layoffs, you have to give the federal government 30 days. This remains fairly static across the country WITH the exception of California and New York. CA and NY both require 90 days notice from companies. Since IBM is cutting in all locations, it would be within the organization's rights to give everyone but NY and CA employees 30 days and 90 days to those in CA and NY. However, if you were to do that - it would be especially assholish thus giving the tech sales team 90 days.

Any sales people out there RA'd and only received two weeks vs. 90 days notice?

Not completely accurate. While it was a PIP with the two weeks, this RA is not only tech sales. It’s across all areas. Senior executive is on record in a public forum stating he is laying off deep so this can be the last one for a while.
