From Bankruptcy Motions - ALL Employee Pay, Benefits, Severance Stay the Same

Sears has petitioned the court to retain all current benefits, pay, and severance packages exactly as they were before the bankruptcy. There are some additional filings:

Executives get full reimbursement for use of their corporate credit cards in their name or the company's name.

There will be sizable retention bonuses in the five figures for top executives as an incentive to get them to stay with Sears and Kmart. Regular employees will not qualify.

And: "The Debtors further request confirmation of their right to modify,

change, and discontinue any of their Compensation and Benefits Programs and to implement

new programs, policies, and benefits in the ordinary course of business during these chapter 11

cases, in their discretion and without the need for further Court approval, subject to applicable

orders entered in these chapter 11 cases . . . "

Therefore, wages, etc., are subject to change if the court approves this motion. Not that there is necessarily intent to change them at this time, but the option is there.

Interesting that the specific language is "Authorizing . . . but Not Directing the Debtors" to pay wages. Language in the motions to authorize customer programs and workers comp do not contain the "but Not Directing" clause.

You can ask for anything when throwing in the towel. The court process will decide, not SHC.

It will depend on what creditors object at the hearing this afternoon. The judge has a pre-written proposed order he can sign, prepared by Sears' lawyers. If he doesn't sign, he will take objectors arguments under consideration and issue an on-the-spot ruling or more likely take it under consideration to schedule future court sessions where both parties can duke it out.

The current pay rate and benefits (insurance) will stay the same as those are protected by law. Severance on the other hand will probably get thrown out by the court.

They may petition it, but the courts can deny the motion, since it would not be in the best interests of the creditors.
