Serta Simmons Files Reclamation Notice; No More Mattresses

Serta Simmons has terminated its business relationship with Sears and is demanding the immediate return of its merchandise, including items sold to customers en route to regional delivery agents.

A massive list of orders dispatched since late August are on the reclamation list, including individual customer orders which Serta Simmons wants back because they have not been paid.

In short, the mattress business is going to be a lot more complicated going forward without Serta Simmons.

Not hubris. The only hope Serta Simmons, or any vendor, has of receiving any recompense within the bankruptcy process, whether financial or returned inventory, for invoices outside of the claims window is by filing for reclamation. It says nothing about how a vendor chooses to proceed in a post-filing environment — it’s two completely different worlds. Will they choose not to supply Sears in the future, or even present? Likely. But this is no definitive indication of termination of relationship.

Not one of the vendors with a reclamation request has even applied to continue supplying Sears. Their supply contracts are voided by the default on payments and they are walking. That is proof right there.

@eag - It's only logical to suppose a vendor that pursues a "legal maneuver" to reclaim their goods isn't going to be suppling additional goods in the immediate future. This action by the vendor would imply a "severing" of the current business relationship until circumstances change.

Also, before you display the hubris to demand information from someone, you should be equally able to provide information that their observation/opinion is incorrect. Do you possess "other inside information" that the current business relationship is unaltered? Didn't think so!

Are some people not going to get their mattresses that they ordered and paid for? Hope they used their credit card to pay. Not cash or debit.

The mattress girl at my former store is going to be more sour than usual because I'm sure the commission leaves with the failed sale.

This is a legal maneuver to recover monies owed that don't fall within the claims window, and there are many vendors already and many more to come that will be filing, but I don't think that means they're severing anything.

After all these reclaimnation of goods from all these vendors there will be no trust from them to supply fast eddies 400 stores. Not working out like Eddie thought is it
