New York State - Unemployment Benefits when Severance is provided.

Has any former VZ Management employees in the state of New York been approved for Unemployment Benefits when they were provided a Severance ?

And even if this gets ruled as "Constructive Termination" (where anyone would quit in the face of the circumstances -- for example, maybe them cutting $10B in payroll and the severance offer would be lower later counts, dunno)... The money you get counts as payroll. So if youre getting N weeks of severance and vacation, unemployment cannot kick in until after N weeks.

I was on a VP Q&A call yesterday morning and they said it is up to each individual state but that generally this is an offer that you don't have to accept, it's not a layoff so no you are not eligible. They also said that when someone applies for unemployment, they send a notice to your employer, Verizon, and that Verizon will contest you getting benefits so I don't see how you would stand a chance at unemployment. Now if you stay and get rif'd, then yes, you can collect.

Applied, Labor Dept called me & very helpful, but was told if Verizon severance payment is paid within 30 days from last day worked, you need wait until it expires. I did not have severance paid to me at this point. They contacted VZ & confirmed it would be paid to me within 30 days, and it was. I began working again, so never collected.

It depends on the reason you are out of a job. In most states the rule is that you must be out of work through no fault of your own, so if you volunteer to take a severance package you may not qualify for unemployment. I would call your state unemployment office to discuss.
