Thread regarding Xerox Corp. layoffs

Help with two questions

Question #1 - how long does it take for me to receive the severance check after signing all paperwork?

Question #2 - are we prohibited from collecting unemployment until the severance is burned up?

Same with Texas - do not collect unemployment until the severance period is over.

In California, I was able to collect Unemployment immediately. It did not matter that I had severance coming to me. I am receiving $450 per week. Enough to feed my dog, cat and hamster. I received my one and only severance check (for 12 weeks) taxed heavily, one month after all my paperwork was faxed to Xerox. Its a good idea to have a lawyer review the "legal" document in the exit package that states you will not file a suit against Xerox.

Everyone before me, received their check(s) during their exit interview ( or, if on direct deposit, money was in account that day). Mine was not. Nor the others walked out that day. Oops....When I called HR, I went in phone prompt circles until I reached an offshore rep who couldn't find my particular situation on her talk tracks. Eventually I spoke with a manager in the US who advised, the cut off had been missed and it would now be 2 more weeks...it was.

For unemployment, nothing in online documentation mentioned severance as an issue so I applied for jobs, turned in info. Not until I requested my first check did I receive a call stating Xerox had notified them of the severance payment which made me ineligible. Apparantly they had not done so during previous layoffs.

It won’t take long to receive your severance. It should come in the next regular pay cycle after you fax over the paperwork. Of course, this is provided that you don’t fax it over after their processing closes for the pay period. So, I would plan to fax it over at least a week before you would receive your next regular pay check.

I can only speak to NYS as far as unemployment goes. If you receive your severance 30 days or less after your last day of employment then you won’t be able to collect unemployment until after the end of the severance period. So if you get 12 weeks of severance you won’t be able to collect unemployment until after the 12 weeeks are up. The last day of employment is is the last day of your notice period not the actual last day you worked. So if you received pay for a non-working notice period, the last day of the notice period is your last day of work.
