Unemployment

I'm curious, can people who've been laid off also get unemployment? Somebody said accepting severance is considered quitting, so most likely not, but I still thought to check.

Not asking for myself. As I said, I'm just curious at what options are open to those who were laid off.

It depends which state you live in. If in Texas, you basically signed away your rights when u join a company. So since I accepted the severance package, I am not entitled to ‘double dip’ until the severance ‘runs out’ ( 2 month or 3 month package) then I get Texas unemployment $$$ which is not much paid by previous employer.

Severance is often given as a replacement of advance notice of a layoff (per the WARN Act). A company can either pay you 60 days of pay or give you a 60 day notice of a layoff. Most companies that I worked for, gave both an advanced warning and a severance package.

Severance pay has no effect on your unemployment. To the unemployment office it is just considered as part of your last paycheck. Always apply for unemployment the next business day after your last day at work.

Even if you are fired you can get unemployment. My last job fired me with no reason given. When the unemployment department called them to get a reason, they gave 3 different reasons from 3 different people. The unemployment department told me that by the answers they got from my former employer, they knew they were lying. The unemployment office had also dealt with my former employer in the past and I found out that they often made up reasons so that people would not get unemployment. I found out later that my former employer wanted to hire someone to replace me at $4.00 less an hour. They never found anyone.

Yes, you can and should file for unemployment. It is paid for by your former employer in the form of extra taxes. If you are in California, this can be done online. If you are the lucky few who does not need the money, then donate it to charity.

I was laid off last year and took my two months of unemployment on principle; no issues with receiving benefits. IF I were in this position now, I would just let it ride and start early 2019 after re-evaluating what it is I really want to do. Decompress and know things happen for a reason!

You can absolutely file for unemployment in California, at least. It looks like a major pain for a dubious payoff - a high-paperwork, barely-updated version of the classic scenes in media showing folks queued at a government office to report how many jobs they tried interviewing for this week, etc. I personally skipped it, though I'm sure if I'd been willing to pay a TaskRabbit to do it, it might have been a net positive. #firstworldproblems

Also be aware that even if you are ever fired when it comes to unemployment there must be cause. If you are ever let go for any reason, file an unemployment claim. It may be initially turned down if you were fired, but it will usually automatically be appealed that the company must show cause such as violation of posted work rules, safety violations or some other reason for the firing. If the firing was because you "just didn't work out", or "they didn't like you" more than likely they will lose the case and you will get your employment. Judges tend to side with the employee whenever possible and an employer must be able to show documentation

Don't assume that because you were fired, that you can not draw unemployment. Of course if you were fired for cause such as theft this won't apply.

Getting laid off is not considered quitting, it is an involuntary separation. Severance should not effect your unemployment rights in most cases. If for some reason you are ever denied unemployment, be sure and appeal that decision as many denials are overturned automatically.

If you get a job and decide to remain within Cisco, then severance will not be offered. Else, you accept severance and find a job outside Cisco. It is advisable to look for job outside.

No, no. It's still a layoff. Accepting a severance does not mean you can' collect.
