Thread regarding Sears layoffs

Any lawyers on here?

Will all this speculation and talk about sears censoring there employees, does anyone have a straight answer? could they legally fire you for posting here? what if you took them to court? could you win a case like that??

O.P.-- Think of it this way, This site has been around since 2009 and no one has been fired yet. So what are the chances that a BK company will now have the resources, time or technology to now pursue someone who post on this site?

Just don't do it on a company computer or on company time and you will be fine.

I've seen all sorts of confusion about this issue. "Freedom of speech" does not guarantee an employee the right to speak out against an employer, on or off the clock. The employee can certainly speak out without fear of being thrown in jail. The employer can fire them. It's that simple. If an employee chooses to work for a company this includes acceptance of their rules, and these may well include restrictions on behavior outside the workplace. There can be variations at the state level, but don't count on freedom of speech as a defense for public criticism of the company.

But in practical reality in this falling apart mess of a organization it's hard to believe management could get their act together enough to fire anybody for posting messages on an anonymous internet board.

I think sears and kmart have way more to worry about than taking employees to court for posting here. It a non issue...even if they try to say it is.

As long as you do it on you free time no worries here. Anything off the clock is your time. As someone else mentioned Sears doesnt have the resources to touch anyone at this point as well. Anything that the managers or any upper management of any sort are doing is a scare tactic.

Not a lawyer, but a Human Resources rep. If your manager tries to suppress your freedom of speech outside of working hours, contact the nearest office of the Nationals Labor Relations Board. A precious company of mine was hit with a charge from them due to our social media policy being too restrictive.
