We now know Sears and Kmart ignored all reclamation notices filed by vendors, with Wall Street analysts noting those notices have no court backing once the legal venue moves to bankruptcy court and some sort of vendor payment system is established. Some vendors took a bath but others used the reclamation notices as due diligence to request an insurance payout from firms that insure vendors in case a company declares bankruptcy.
