Thread regarding Oracle Corp. layoffs

Has anyone else had issues after using the EAP?

I have a friend who was supposedly told in a private call by one of his department VPs that he was denied a promotion because he took some counseling under the Oracle Employee Assistance Program when his gf left him and because of this he was deemed "emotionally unstable" and "unfit to be promoted".

He could not prove this as the statement was made in a private call, with no logs or recordings. I thought the EAP was supposed to be 100% confidential, but it seems that is not the case. Has anyone else had this problem?

all things considered, I'm a better person having used EAP to go to therapy than I would be getting a promotion so if that would be standing in my way of a promo I'm considering it a win. A few posters on this site could probably benefit from some EAP services - and I wouldn't be worrying about promo's.

I would consult an attorney. This seems like it should be illegal. Unless he told someone he was using EAP and why, I don't understand how they could know. It seems to me this is a violation of the right to medical privacy. Mental Health not different from other illnesses except for the stigma.

Def folks who had long sickness or STD are not promoted. Lawsuit is useless - in this country the cards are stacked against the employee. It's the home of capitalism for google's sake.

Oracle considers it a strike against you if you use EAP, disability or anything that they can if they want to find a reason to not promote or fire. The excuse they can make up later, and there is no person, lawyer, gov agency or anything to hold their feet to the fire. Your employer holds all the cards. That it is it is. That is how it always was. World without end, amen.

As much as I dislike Oracle that’s c-ap advice. Bring up suit based on what? Oracle does not have legal or contractual requirement to promote anyone.

Tell him to bring a law suit.

There may not be any proof that he was told that but Oracle will have to explain the reasons why he was not promoted. If he deserved the promotion then they will be unable to come up with any reasons.

IIRC, Oracle does get back EAP usage statistics, so it is quite possible that they legally get to know that employee John Smith used EAP services. The rest of it is (hopefully!) confidential but in this context all that matters is that service has been used.

Didn’t have similar experience myself but compared to life events that prompted me to use EAP missing Oracle promotion would have been small beans indeed. Still, what happened here s---s big time, there is a lesson there. He should leave.
