Xerox doesn’t lose many legal battles

Anyone who received severance had to sign a document stating we would not be involved in any legal action. Unless the courts decide we were ‘coerced’, that would remove the majority of us from a class action suit. Don’t get me wrong, I’d love to see all of these crooks go down, having to spend the money we earned for them, on legal fees. But, I don’t see it happening. Xerox doesn’t lose many legal battles. I can only hope that karma does exist and those involved feel the collective pain they’ve caused.

I’m the original poster. No, we were not required to sign ‘on the spot’ but there was a documented time limit. Our document stated no legal action, not individual, nor class action. I read the multiple pages on several occasions. Every loophole was tightly sewn shut. ( No signature, no severance, not even the crummy 1/4 severance i ended up getting)

I know of several people over the years who sued Xerox. In one specific situation that began YEARS ago I knew 2 involved. One has since died. The other is still waiting...I’d prefer to spit out the bad taste of Xerox and walk away, but for those moving forward with litigation, good luck. I hope you nail them to the wall !

You do not have to and should not sign on the spot. Once you sign you are agreeing with all the terms that Xerox has proposed. Once you sign you have no leverage to negotiate.

So speaking of the documents that you are asked to sign when you get laid off… Do we have to sign those documents right then? Is it possible to take the documents home to read through and then sign and return later? Personally, I'd like to have time to review any legal document before I sign it.

I can speak from experience that Xerox loses legal battles. The person who stated that, never sued them.

That said, any good law firm would give you a free evaluation of a claim. They will explain the law and if the suit has legal merit. Further, the Bar and many states have disclosure laws so they need to tell you the cost structure. A good lawyer will advise you on the below as well.

The first thing you must evaluate is the time...1 to 2 years, second the emotional investment, third the potential return, forth your name on case file if formal lawsuit is filed (if you are lead party) will likely be pulled by a future employer background check, and lastly but for some the most important gaining justice. Don’t confuse justice with revenge / retribution...not the same.

The document did not say that. It specifically allows participation in a class action lawsuit. Unless some received different versions, which might be a whole different lawsuit.

Repeat - the agreement ALLOWS and does NOT PROHIBIT lawsuit via a class action. It prohibits individual legal action, but even that may not be upheld in court if challenged. Think about the waiver at skiing or amusement ride venues-it’s meant to scare but valid suits go forward. Uncommunicated severance policy change and age discrimination are two valid potential actions that can be brought to the court.

This is not the same Xerox who didn’t lose many legal battles. How competent the new regime is yet to be determined. If you can somehow organize; you may be successful.

Can you say Fuji . The retirees benefits . . Xerox loses if you don't back down and fight . Call the eeoc.and the national labor relations board to see what you can do . Check the labor relations board web site to check and see what laws Xerox has broken. Also remember they represent you with their lawers .take a chance. With a law suite .
