If You’re Over 50, Chances Are the Decision to Leave a Job Won’t be Yours

ProPublica and the Urban Institute, a Washington think tank, analyzed data from the Health and Retirement Study, or HRS, the premier source of quantitative information about aging in America. Since 1992, the study has followed a nationally representative sample of about 20,000 people from the time they turn 50 through the rest of their lives.

Through 2016, our analysis found that between the time older workers enter the study and when they leave paid employment, 56 percent are laid off at least once or leave jobs under such financially damaging circumstances that it’s likely they were pushed out rather than choosing to go voluntarily.

Only one in 10 of these workers ever again earns as much as they did before their employment setbacks, our analysis showed. Even years afterward, the household incomes of over half of those who experience such work disruptions remain substantially below those of workers who don’t.

“This isn’t how most people think they’re going to finish out their work lives,” said Richard Johnson, an Urban Institute economist and veteran scholar of the older labor force who worked on the analysis. “For the majority of older Americans, working after 50 is considerably riskier and more turbulent than we previously thought.”

I beg to differ, i believe there is a strong bias against 50+ employees among top management and the data, were somebody to get it in discovery, would clearly demonstrate it. The way oracle hides this bias is by having a multitude of layoffs throughout the year and sharing just isolated pieces of information for some of them in the few WARN it has to file. Nobody outside of oracle HR/ senior execs sees the full picture, which picture is very ugly.

ORCL and any other Fortune 1000 USA company would never mostly clear the deck of the 55+ age bracket in a given layoff without corresponding numbers in the 35- bracket, even with a justification that they need to cut back on higher paychecks. That would make it far too easy for lawsuits to hatch. ORCL gets guidance from external HR partners that deal everyday with this tricky issue. If you've been part of a large ORCL RIF, you've seen the detailed and mostly balanced age bracket numbers that are posted for affected employees.

@X3D3EJ9-1bua Thats a bit of a generic statement. Employee rights vary dramatically by state. In some states they are stronger than others.

But that doesnt mean an employer can just fire someone whenever they want. They cannot discriminate.

In the US, there are zero employee protections. You can be dismissed at any time, for any reason. Period, end of sentence. Employment at will. Also means you can resign from a job at anytime for any reason. Seems fair, but the corps have the advantage.

@X3D3EJ9-umr Yes its illegal to RIF someone because of their age.

However its likely that because they're older they are also earning more money. So instead of it being because of their age its because of their salary.

The end result is the same. But the reasons are different.

Now if you are RIF'ed and are older than your team, but performing better/equal and earning less/equal than you might have some legal action to take.

Wonder if this is illegal and if it would stop companies like Oracle from this discriminatory practice if they were sued in a class action lawsuit.

Any takers? Any list of employment lawyers that would take the case?
