I saw this post and was a little concerned since you had issues with your severance (if the pay checks just stopped etc). I got my last payment today double check it was paid correctly. Ever since I fixed everything my 2 payments were smooth.

However I had issues in the start when I sent all the paper work (being smart) I called like 5 days after sending everything they said they received nothing. I was like wow. So I sent everything via email (instead of fax this time) they got everything I was pushing it again I called and was confirmed. So I got my severance as promised. It was just one month, but better than nothing (I swear this extra $$$ was unexpected did not see this coming at all). Plus I even wonder if I was still suppose to receive it was in the company for 6 years, but only was full time for half an year before we closed.

So if anyone that is getting severance push it big time! Send the paper work ASAP and be on check call and see if they got the paper work. At this point you never know where they will announce no more severance because the company is going Chapter 7 or whatever excuse they can give you.

I didn't get my first check as expected, either. Called HR and payroll who claimed they never received my signed form (even tho someone else had verbally confirmed that my paperwork was there). I re-sent and followed up again. Next pay cycle, I had my check.

Be prepared to act on your own behalf--no one else will. Start making calls to track down what happened and re-submit any forms they claim to not have. And stay on top of the amount of money they pay you too. My severance stopped again once they'd paid half of what I was supposed to get. I did one more round of calls and finally reached someone decent enough to care and smart enough to know how to get my money through the system. Hang in there.

Head down to 14 Indian Creek Island Rd in Miami and take a fully charged car battery, some jumper cables, and a 1/2” breaker bar with you and have a blast.

Typically it is late in coming on the first check. Mine took 3 weeks and then was paid after that on the normal pay cycle of the 15th and 31st.

But that was back in November.

There is nothing you can do. Sears is not contractually obligate to pay severance unless it's stated in the application or thy myriad of paperwork that is required to be filled when bringing on a new employee.

Maybe contact the dept of labor in the state where you reside,

Good luck
