WTC layoff employees are under WARN which means they will receive salary and benefits till April 9, 2019 under federal law.
On page 2 of the Severance release agreement, GM mentioned a release of claims under WARN act.
Does this mean one give up his/her rights to WARN and 60 days benefits? On Q&A, they say that employees under WARN will be paid for the full WARN notice period under federal law. Does the document we sign ask one to release his/her claim or not related to WARN?
Also, because of the 60 days notice of WARN which stipulates employment till April 9, what does it mean in terms of bonus, are we still "employees" till that date under federal law? If so, do we need to sign a release agreement to see the bonus? What is our status between March 1st and April 9 according to the federal law? Employee or laid off with full benefits and salary?
In general, how the release agreement is beneficial for people laid off with less than 4 years at GM and working at WTC? What does WARN not cover?
Bottom line, do we give up claim to WARN or not by signing the release agreement, for those who read the page 2 of the document ?
