Any associates that were owed severance before BR cut you off

Whomever filed a form 410 to primeclerk for unpaid severance. It looks like the bk court is ordering payment to affected associates. 4/10/19 is the cutoff date for late filers. Get off your arsses and file if you haven't already! Your time will come to get paid soon. Got to apply to get it. Might take some time, but worth it.

Pretty ridiculous that we had to wait so long.

The Seeking Alpha article this morning makes it look unlikely that Sears will exit BK. No money for Admin costs, Severance pay is an even lesser priority. Not good news.

If your 410 claim is listed in Primeclerk as Unliquidated, Contingent, or Disputed then you must refile before the cutoff date. If your severance was cut due to the BK filing, then your case would be listed as Unliquidated. So therefore you would need to file again, or give up all claim rights forever. Please read your paperwork that they sent you. Do not rely on potentially inaccurate info on this board. Good luck!

Is this only for those who lost their stores before the bankruptcy?

My store was one of the 142 that closed in the first round after the filing and I got these same papers last week, but I would rather not file them if I'm not eligible. I would prefer to not be fined or jailed for filing a false claim.

If you already filed, check the prime clerk website and view your claim. Make sure your claim does not have the letters C, U or F after the claim amount. If it does, then you have to re-file. Mine has been sitting there since October. I browsed thru the list of claims and noticed some of them do have those codes after the amount, but in general they seem to be vendors. Supposedly our claims have priority over unsecured creditors but we are still down on the totem pole of claims after admin and secured claims.

My wife already died when my pension lump sum was cut off. We couldn't afford to pay for medical treatment anymore. Eddie already killed her. It's too late.
