Thread regarding Oracle Corp. layoffs

Can they get rid of your severance by rehiring you?

I put this in another thread, but I really wanted an answer to it, so thought I would post it here.

So, suppose you are laid off and then take another job at Oracle shortly afterwards.... then you have to give back your severance, right? There are posts on here that seem to say that.

Then when you take a new job at Oracle, that will have a new start date, right?.... so you lose your years of being an oracle employee, right?

Then, if they RIF you after that, there is no severance to pay?

Wouldn't that be right?

Does it work like that, or do you get to keep your years of service somehow?

If you are rehired within 6 months, you are not considered new hire, you keep original date of hire but you will have to repay retroactive severance. This I am sure of.

After 6 months, you keep severance (this is in severance paperwork) and at that point I believe you are considered a new hire, although I am not 100% certain of this last point.

Everything is negotiable. You should negotiate a higher salary and keep the severance. If not, you should be able to find something comparable or better elsewhere.

No repayment after being gone 6 months and rehired. Those were the terms I saw.

You wouldn't lose your years of service upon being rehired. In fact, you would get back your old employee number. The paperwork does say that you'll be asked to repay pro-rated severance but I know of someone who was rehired a few months after a RIF two years ago and he said "I don't have it". They wanted him so they waived the repayment.

Severance prorated and years of service back. No double dipping unless you pinch a loaf and don't flush.
